There is an item in the Constitution called the Constitution's Supremacy Clause. Quite simply stated, Federal law trumps any and all conflicting State law.
 
Why dont we have a specific thread to discuss things like this without them getting deleted.I think it would be a good thing,to be able to get alerts out about pending legislation after such a tragedy such as this.We in new york state are just days away from a total confiscation bill.Now what?

This is a real sticking point with the determination by the SCOTUS. The final wording, as written by all 9 Justices in the Heller case, though it upheld our right to keep and bear arms, also states "the States reserve the right to reasonable legislation". Reasonable, unless challenged in court, will be determined by your State legislators.

The states have been testing the waters on this. Guns made in state, pot, etc...
It will be interesting to see what happens. Can a Fed be arrested for breaking state law by trying to enforce Fed law? Thats the way the Wyoming law reads.
 
They certainly can be arrested, as long as the State law is not of a nature that conflicts with Federal law.

Jon, I just was reading an article in the NY Times and it says that Governor Cuomo made an off the cuff remark about total confiscation, but has since backed off on his earlier remarks. According to the article such legislation would not get the support needed to pass. Am I missing something? Ray

Jon, I assume you are employed in the state of NY and don't have much choice about whether or not you reside in that state.
As for me, I am a "resident" of South Dakota although I have never owned property there nor have ever lived there. I am currently residing in AZ and I don't think I have any gun ban laws to worry about here. But I also temporarily reside in other states. If a state that I am "residing" in tells me my guns are about to be confiscated, I will pull up jacks and take my "wheel estate" to another state.

If, as I expect, the Sacramento crazies give full vent to their insanity this year; I will buy a house and establish residency in Wyoming. San Diego is nice but there is a limit to what I'll tolerate.
 
Steve, it gets mighty cold in WY in the winter. :( How about one house in WY for the summers and one near Ben Avery for the winters? ;)
 
I thought about it, Bill. But I will still have the San Diego house. It's just that the blood suckers will not be able to lay hands on my newly "illegal" guns and they won't get any more taxes from me. >:(
 
Sounds like a good plan to me.

The company I retired from was headquartered near the Santa Monica/LA line, not far from OJ's house. They wanted me to move to that area. But after seeing real estate prices and knowing all about the horrendous traffic, I said "No thanks".
 
Yep, and it won't be long before Carlsbad 7 Oceanside are San Diego suburbs. Or is it that way already?

Back before retiring, I usually worked at Qualcomm Stadium a couple times every fall. Also SDSU.

So are you suggesting that people can't use their first amendment rights to speak out against somebody doing something dumb? Our rights limit government, not individuals. She isn't violating their rights unless she uses the power of government to stop them.
