Red flag laws

Numerous times in NY I "investigated" reports from wives angry at husband and headed for divorce. Usually the report came after the "incident", sworn statement by her, and usually within days of deer season. Stuck with dubious "probable cause and a metric ton of liability, the Judge would order the guns held, place an order of protection on the hubby keeping him from possessing any weapons, and then long after deer season was over she would get the divorce, drop OOP and lo and behold, feel "safe". Usually the guy would lose two years of hunting while his guns sat in the armory.

Red flag laws are a joke. They are nothing more than mandated intervention. Gone are the days of letting the local judge make a discretionary call.
 
These are just a logical extension of the domestic abuse laws.

Your wife or significant other can go to the local LEO's and say she feels threatened by your continued presence in the home. They will escort you out of the home, until such time as a judge has time to consider your case. You will NOT take any firearms with you, or be allowed to possess them.
A good friend had this happen to him. He drew a once in a lifetime Moose tag, and was packed and ready to head out after work. She told him she had plans to visit her family, and his presence was required. He said "no thanks" and when he arrived home he found a sheriff's deputy waiting. She thought she would remind him who was the boss. He did find the only effective response. He zoomed over to the bank, left ONE dollar in the checking and savings accounts, called the VA and had them switch his direct deposit retirement check to his brother's bank. He borrowed my bow and went on his hunt. When he got back, she had gone to court and had the charges dropped. Did not know he had gone on the hunt after all.
Hers was the punitive use of the law that got the legislature to change the law. Now, in Idaho at least; the woman files, but does not follow suit, she is charged with filing a false police report, and is generally not allowed to file again. It is also, iirc, a felony charge with some jail time.

He had a happy ending, he filed for divorce and got everything his attorney asked for.

My son had almost the same scenario in NJ but his turned out just the opposite. She got everything including the kids & he got nailed to the cross. 15 years later he is just digging out from under the financial shit storm!! Plus he lost his(actually my) guns. She accused him of stalking when he was actually with me here in Vegas. When he got back he was arrested!! NJ is so corrupt the laws will never change & you will never get an honest judge.
He also never got his guns back. We found out 10 years later that a judge in Ocean County had both of his rifles. He was told they were destroyed. And we did try to get them & prosecute the judge but we all know how that goes in NJ!!

I had a woman whom I had never met, never seen face to face, did not know her name, or anything about her, get a restraining order against me claiming I was stalking her.
I had passed her on the road only, had no idea who she was, only that she was renting a house down the road from me and drove a ford pickup. Of course I had to not possess any firearms for 3 weeks until the hearing. I spent $7000 on an attorney. She showed up at the hearing, that was the first time I had ever seen her face to face. Fortunately for me, the cocaine addict judge that had some kind of problem with me, was not there, it was a different judge. When the woman found out that she would have to testify under oath, she dropped the whole thing. But, she then had the balls to ask the judge to force me to pay for the filing fees and service fees!!!

She stole 3 weeks of my life from me. What was the downside for her? $150 and half a day off to come to the hearing. The cop had coached her on what to say and what to do, because in his words "I know exactly who you are", the same cop that also told me it was ok for him to lie to me "because I have a badge". POS cop in a corrupt department that had been openly trying to screw me over for years. They make up stories about what you said, what you did, and who is anyone going to believe, you or the cops?
The system as it is has plenty of room for abuse, laws like this are made for abuse.
 
With the incompetent,indifferent or corrupt judicial system and the manically hysterical emotions of today's women the bullseye on a man's back just got painted a brighter red ! I have experienced both ! Ralph Mollett
 
I'm not disagreeing with you on the (un)fairness of the application of the law. I'm simply saying that convincing a judge is all that's required to meet the legal definition of "due process," the same way that a judge issues a search warrant based on input from just one side (law enforcement).

Laws like this are just teaming with ways for abuse. Now to go out on a limb ....... I hope we can all agree that any time your name is on a list it can always be found . Now inter the NRA who announced last week that maybe we should take a closer look at this law to apiece the machine. ... where are over 5 million gun owners registered? Now inter George Sourous and his billions.... now all you need is a telemarketer system that calls from a ghost dialing system that can dial from a local area code .... with a list of dead voters from that area and say you, the gun owner just threatened them with a gun and boom , the socialists plan to disarm America is in action. At our expense. Laugh if you want but it was a system not all that far off from the one I just described that Hitler and stallen used to disarm their people and we all know how that worked out.
To think that the police and judges are upstanding people you are lying to yourself. I personally lost all respect for most law enforcement when I was a cop .

I know for a fact that most L.E. officers are good, decent people with a strong moral compass because I know and work with a few. I also know for a fact that these fine examples of L.E. are powerless to remove the few bad cops in their precincts. I suspect that their biggest fear is to be near the bad cop when s/he goes off the rails, and be powerless to do anything to protect the civilians put in danger by the nut with the badge and gun.

In my lifetime, I KNOW a cop that killed two hookers and a pimp, dismembered them, then stuffed them in 55 gal drums, placing them in Golden Gate Park, SF. He was caught by his fingerprint INSIDE one of the barrels, but not before he killed another hooker, took a hammer to her teeth, a torch to her fingers, and dragged her dead body behind a car for several miles, tossing her off the side and lighting her on fire.

I also dated a girl who's ex was a sheriff who'd handcuff her to a fence post outside, naked, all night in near freezing temps and then molest their two daughters. She ran away twice but was caught by his cop buddies and returned to a judge who told her "if she wasn't a good little girl, she get locked up and her parental rights taken away". He was eventually sent to prison but not because of anything he did to her or the kids. She spent 5 years on a lecture circuit afterwards enlightening law enforcement departments in various cities about this kind of abuse and how "the blue wall" perpetuates it.

These sicko's had buddies and co-workers in L.E. They did not operate in a vacuum, yet nothing was done to safeguard the public until long after the violence and killings. And I believe that kind of corruption is at the heart of what's wrong with "the system" as it now operates.

Just my personal experience. Yours might be very different. Feel free to take from it what you will. I offer it here because I know most members are red blooded Americans with a strong sense of fair play and law and order, and that the two are not always mutually exclusive.

1911 Turkey established gun control/ confiscation. From 1915 to 1917 1.5 million Armenians that were not able to defend themselves were rounded up and exterminated.

1938 Germany followed suit. From 1939 to 1945 13 million Jews and others were rounded up and tortured and exterminated.
1935 China followed suit. From 1948 to 1952 20 million political people were rounded up and exterminated.
1956 Cambodia followed suit. From 1975 to 1977 one million educated people were rounded up and exterminated.
1964 Guatemala followed suit. From 1964 to 1981 100,000 Mayans were rounded up and exterminated.
1970 Uganda followed suit. From 1971 to 1979 300,000 Christians were rounded up and exterminated.
During WWII Japan decided not to invade the us because they knew most Americans were Armed.
Ya I know , anything is possible.... in my imagination right?
