Private gun sales

Excellent question ! So much ambiguous wording in the mandate that it is hard to know at this point what you can do, all intentional IMO so they can selectively go after anyone they wish to make an example of.
Yes. A little surprised it’s not been hashed out on here?
 
Mandates are not law...!!!
If you allow them to control you they will.

Only the Legislative branch can make and pass laws. The Federal government can not govern private sales that are not Interstate Commerce. There were some documents written around 1787 that explain this.
 
I “deduce” that if we sell a gun here and ship it to an FFL near the buyer, the FFL does the background check on the buyer so we’re good.
I’m not a lawyer and trying to read thru the proposal gave me a headache. I don’t keep “records” except the serial numbers of what I own. If I sell a gun, I scratch it off the list.

Been paying close attention to this as the very wording is meant to entrap law abiding citizens doing nothing more than selling private property as has been legal to do until the ninny state created another law, safer communities act 2022 I believe from what I'm reading, saying we can't do that anymore.

The only thing I don't see written in this is trading or bartering but I'm sure that's hidden somewhere or on the short list to be amended to make that a punishable offense.

NOT, that would be a gunsmith. IMO relax people. If you sell a gun or guns on Gunbroker and complete the transaction using a ffl, you are good. If you take a trunk full of 9mms to the hood and cash them out, you are and should be in deep sheeet.
 
I need to read this as this might be the reason why Savage Arms told me they will only sell a firing pin spring to an FFL for a 20+ year old rifle!

Savage doesn’t like to sell many parts to the general public. They’ve always been that way. Has nothing to do with this new forced thru law.

This law is written so it basically implicates anyone who tinkers with a firearm. You rebarrel your gun…guilty! You swap the stock…guilty! Change triggers…guilty!
Not to mention there’s another section about personal firearms that states that you can sell/work on your personal collection.

This is the "catch 22" of this new rule when it comes to personal firearm sales. they say you can sell guns from your personal collection, but notice that in that definition they don't mention any of these specifics that restrict what firearms are considered personal collection guns and which ones are self-defense guns. It also didn't point out that you can only sell of your personal guns w/o being considered dealing in firearms IF you never, ever, ever buy another gun - because if you do buy a gun in the future at any time, all those guns you previously sold will now be considered as sold for profit rather than the liquidation of a personal collection.

There is much ambiguity in this new ruling. I think it will definitely make an impact on face to face transactions. This will force many to use a dealer to dealer transaction that will leave a paper trail for the lawyers. The crooks will not honor this or any other ruling or law.
 
Whether its a law or not, they will prosecute you and I just like it is, and the expense will be just the same.

No, that's not what it says.
There's a bunch of criteria that MAY indicate you're a dealer and a bunch that MAY indicate you're not.
 
I'm not sure using an FFL to transfer guns actually eliminates the risk of being considered a dealer under the new rule. Folks that meet the new definition of a dealer must be licensed AND conduct a background check. It's not clear that using an FFL is sufficient. We really need clarification on what actually makes a person a dealer. At this point, I'm thinking anyone who has legally bought and legally sold a few (i.e. many of us) just might be considered dealers under this new rule.
 
I note in "similar threads" that the potential ban on non FFL private guns sales was locked. I am only pointing that out to mention that Feb was a little late to be discussing it, considering we are today.
 
This is just more BS from the luny bin in charge. As we all know, a deer rifle is the weapon of choice when robbing a bank! Where does it end. When the current idiot is finally sent to the funny farm to sit around and drool and hug people inappropriately. Hopefully this will be corrected in November. Carry on.
 
In Virginia, all private gun sales now require a background check performed through a FFL dealer.The only transfer of a firearm that does not require a check is if you gift the weapon.
