NICS background check

Does anyone on here get the DELAY response?
I have always received this response since I was about 21 yr old and still do. I am 38 now.
For the last past year folks have not been wanting to give out a gun that has gotten a DELAY response because they are caliming that they can possiably be sued.
If the rules are being followed why would the ATF push FFL holders not to give out guns with a DELAY if the rules say you can?

What "folks" FFL's? I'm an 01 FFL on the border where things are hairy and no ATF agent I have ever spoken with has ever mentioned anything about holding up a delay. The law is plain and simple, if no response in 3 business days after initial you get the firearm. I get a lot of delays because of proximity to White Sands missle range and a NASA facility and folks with top secret clearance's, those buyers DO NOT exist at least in NIC's data base hence a delay. I suggest you find another FFL/FFL's they are jacking you around.

When they first started doing this NICS b.s., I suddenly got 'delayed'. No criminal background, in the military, working on submarine nuclear propulsion (with a security clearance and federal background check to go with)... heck, hadn't even had a speeding ticket for a couple years.

As it was explained to me, the automated system flags that you have a background file. Doesn't matter what it is, or what it was for, but that you have a background file. Then some meatsack has to go and physically put eyes on that file to accept or decline the transaction. Meanwhile I'm sitting there waiting, fuming, 'delayed' because I at one time had a military security clearance. Joe Crackhead can go ahead and buy his TEC9 bullet hose - because he hasn't been caught by the po-po - yet - but for serving my country I get 'delayed'. As you can probably guess, that causes me no end of aggravation.

There is a simple solution, though.

Don't put down your SSN on the form.

Your race is mandatory. Your sex is mandatory. Where you were born is mandatory. Your SSN is *optional*.

They say its there to prevent misidentification that could cause you to be delayed/denied... all I know is I got 'delayed' three or four times in a row over a couple years after NICS went into effect. Then I stopped putting down my SSN, and have had nothing but clean sailing ever since.

The FFL holder is a good friend of mine. He told me ATF jacked him around about the delay and took a photo copy of my information. ATF Told him that if I shot somebody with that gun he could be in a civil law suit. He said he was only telling me this because we are friends.
Another FFL hold that would not do me because of a delay told me the same thing about getting into a law suit.

They're fumin' over nothing! As long as the law is followed, to the letter, and with proper documentation, there's nothing to be worried about. Sounds like they got some second or third hand horror story, where not all the facts and details were provided. Yes, for some reason, it usually takes longer for a 'proceed' for active duty military and some others. Ever think about getting a "Unique Identification Number"?
 
Thats the thing, I never get a 'proceed' .
I always have to wait the 3 or 4 days and then get my gun.
It has really not bothered me until now due to FFL holders tell me that they wont let my rifle go with out a proceed.
How do I get a Unique Identification Number"?

Getting the background check for NFA items can go faster in some situations though due to having a clearance. It is very similar background check to clearance set up so by already having it done it is possible for that type of firearms check to go faster. I had my paper work processed in about 2.5 months which amazed my dealer.
 
I need to get something like that.
I have had back ground checks before.
30 day back ground checks. To work at SHAW Air Force base and Savannah River Plant. Also short back ground checks to work at Fort Bragg,Fort Jackson and Fort Stewart.

From what was explained to me by people with high clearance's they don't exist because of security reasons like someone hacks system thinks they may be a good grab or their family. I just stated the facts, call ATF and ask I don't know the why for certain.
 
Figure as long as they keep saying yes and I dont do anything stupid than I have nothing to worry about. Besides if I wait I can always get a deal at a show.
 
The NICS was set up for checks on gun purchases only. Background checks for clearances in sensitive areas is a completely different ball game. In each nuke plant that I work, I have to fill out a PHQ and am subjected to a background check each and every time. These checks don't go through the NICS. This is handled by the FBI and a contractor.

Also the FBI said that just because they check and you have a good record dont mean thar NICS is seeing the same thing. So if you pay the money to get back ground check done with the FBI to make sure your record is clean dont update anything with NICS.
 
I didn't have a delay i was denied the purchase of a fire arm FIVE YEARS ago, had too get a lawyer to look into it with the PA State Police ANSWER NOTHING WRONG so now have a DENIAL LETTER i have to show every time i purchase a gun or renew my Carry Permit have the original letter in my safe and make lot's of copies.
 
It's nice to live in a State where if you already have a CCW,there is no NCIS check.Shouls be a national set up.
 
It's actually a waste of time and money for a FBI background check. What you get is a copy of your criminal history, if you have one. A true background check takes time and money. On the average, the cost of a complete background investigation is somewhere in the $1000.00 range, depending upon the number of applicants being processed. By the time they have completed the investigation, they know more about your life than you can remember.
 
Joe O: I also live in Pa, have had a carry permit since 1974, and any time I buy a handgun or rifle thru a dealer, the purchase goes thru the NCIS instant background check. I have never been asked, by the dealer, if I have a Pa. carry permit: does not matter: everybody goes thru the instant check. Takes the dealer about 5 minutes on the phone.
 
A number of states have waived this requirement for CCW holders Frank. Not sure how many or which ones, but can tell you the state of AZ. is one such state.

Texas waives it too. Main reason I got a CHL actually. That and the favorable treatment when pulled over by the traffic cops ;D
