NICS CHECK: Delay. Why did it happen?

I’m in Texas and enjoyed the same laws. I got my Concealed Carry partially because my favorite FFL kept bitching about the extra paperwork.
Extra paperwork? Maybe the state of Texas does but the only difference i did between the 2 when I had my FFL was make the NiCS check phone call other than that it was just filling out the ATF 4473 and my log book unless i had it less than 24hrs, in either case paperwork was the same
 
I believe if you dont hear anything in like 72hrs then the transaction can proceed something like that used to be anyway.
Its not up to the FFL holder to find out reason either its upto you to find out why.
Don't know if Wyoming has a law were if you have a CC permit you by pass the NICS check only have to do paperwork its the biggest reason I have my CC permit.

I’ve never bothered with a CC permit due to my state’s excellent Constitutional carry laws. But now I’m reconsidering.

The FFL may at his discretion transfer a firearm if NICS does not provide approval in the 72 hrs time frame. This does not include the day of the call, day of the transfer, weekends, holidays, etc. Government offices must be open for business for the clock to tick. The FFL does NOT have to make the transfer, i.e. the management reserves the right to refuse service to anyone.

When I got my license 15 years ago, it used to be NICS would either proceed or "further review." Further review got you transfered to FBI from the call center and they would either delay, deny, or proceed a buyer. Further review has gone away, if the contacted call center cannot issue a proceed the buyer is automatically given a delayed status. Also note, thanks to the BSCA all buyers under 21 now are delayed for up to 10 days automatically before NICS will issue an approval.

Further, once NICS is initiated, you have to wait for the clock to tick or get an approval before the transfer is made even if your state has a license or permit alternative to NICS that a buyer produces ex post facto. Failure to do so is transferring a firearm not in compliance with the Brady law. With the current administration, you WILL lose your license at best, at worse be prosecuted.
 
Well……he does like to give me crap. All in fun, tho. I think I get to skip the NICS background check.

I walked out of the store late in the evening after NICS was closed because I have a CCW with a new Kimber 10mm and ammo. The lady in front of me with the dog in her purse looking at pistols with no clue what she should get got sent away after about half an hour and told to return the next day with id showing her current address. Sure makes it nice to not have to come back when NICS is open to perform a transfer.

I get delayed every single time. Without fail. Every single time. Doesn't really matter as Illinois has a stupid assed waiting period anyway, but it's the principle. And I'm a retired cop.

Get a UPIN, look up NICS VAF.
 
My mother used to always get delayed. Turns out, there was a woman with the same name as her in our town who had a history of passing bad checks and was a "prohibited person".
 
I've been delayed twice. Once for about a week. Had something to
do about the U.S. no fly list. I'm of Czech and Russian heritage. They
probably thought my name was too close to someone on the radar.
System worked in that respect.
 
And that’s my big concern! I’ve been second-guessing myself and wondering if I filled out the paperwork wrong.
I had a similar situation. Bought a 22 pistol at a gun store and later that same day bought 500 rounds 22 at Big 5 sporting goods store. I wonder if the pistol and ammo purchase on the same day had something to do with it. It all worked out but stressful.

Dunno. NICS isn’t done for ammo purchases. That’s a blue state thing.
 
NYS has this neat little law where you can be put on hold for up to 30 days while they do their “point of contact” check. Only issue is Federal NICS expires at 30 days. So if NYS has an issue with your name and they are back logged, you get to start the whole process over at 30 days. I haven’t experienced it but a co worker took 90 days to get his firearm.
A buddy from Long Island waited a year for a handgun. A YEAR.
Bonus: he had to pay for the gun on the front end.

I usually have a longer wait than most people for firearm purchase approval. We finally figured it out. During my working life, I had multiple nuclear clearances and fingerprinting for my job. Still shows up and makes the powers that be take a closer look.
i dunno -except for one where i put in wrong info mine have all gone through in a few minutes. I worked the skilled trades and had alot of security checks run on me and in the nukes some. i always figured since i allready had all the security stuff done so many times it helped move the process along.
 
Yesterday I go to pick up an action I ordered. I told the guy my NICS checks always seem to take a while but this time I get put on “delay” (or hold or whatever the term). The guy said it happens. I called a buddy who’s an FFL and he said the same thing. So now I have to patiently wait for a phone call and get the action. Takes all the fun out of it.

Does anyone know why this happens?
they dont want us to know the reasons as that would help criminals game the system. Its wierd- once i put my address wrong on the 4473 at a local walmart and they refused to sell the gun to me and said i could never buy a gun at that store again. i tried later to find out and sure enough they wouldnt sell to me— but the other Walmarts in the area would all sell to me no problem— go figure— fortuneatly for me all others i have purchased have went through quickly.
 
Anyone remember the good old days before the NICS check when you could send a money order to a mail order gun vendor and have it shipped to you no questions asked? This was before Kennedy was assassinated. There were many outfits that sold WW1, WW2 and Koren war military surplus, long arms and pistols. I remember Mausers, Springfields, Lugers and P38s in the ads. Lee Harvey Oswald, ended that sales method.
 
I have a friend that is a combat wounded veteran. VA disability. He got turned down
. Came back as him being deceased, so go figure.
 
When I was in PA, I sailed through for years, then about 5 years or so back, every transfer became delayed. Always passed in the next 24 hrs. Since I moved to another state, no issues.
