ITAR Registration -- Plan on Paying your Gunsmith more...

Does any one know the definition of firearm , as far as ITAR is concerned ?
Blackpowder, air guns ?

According to the U.S. Munitions List the only exceptions are BB and pellet guns, shotguns with barrel 18" and longer and black powder muzzle loading firearms. U.S. Munitions List 121.1 Page 2 Catagory 1 line (a) Have you called your Senators and congressman yet?
 
I strongly disagree with what is going on here as far as the new imposed "tax", but I would like to know what their definition of "in the business of" means? Could mean that you are conducting an actual business.... or that you are just engaging in an act of. This would mean than anybody with a lathe that puts even 1 barrel on for themselves is not in compliance!

That is a much broader scope than just the small gunsmiths!

I don't think you even need a lathe. If you put a barrel on your buddy's savage you've changed the caliber.
 
If you change out an AR barrel since it requires a special wrench you are now a manufacturer according to the DDTC. I was told this DDTC order is not in affect right now so there is time to change it.

When talking to the gentleman at the DDTC he did say it is a living document and can be changed.

It can be changed and it is not in affect according to him. He said if they get enough push back it will get changed he suggested emailing the email address I posted. I think flooding them with calls and emails is the best option. People get sick a fielding calls faster than emails.

I think it was a executive order . Obama
Obama can change it .
Congress can or federal court.
None of the above will happen till after election. The way I see it there only one
 
My understanding is its also has to be funded. Another way we and our politicians can stop this war on small business and 2nd amendment.

I was told by the DDTC it is not a executive order it is a Guidance by the DDTC the executive order was to in force the Guidance. I told the guy I talked to good luck charging some one when the ATF and TTB say that a gunsmith is legally operating under their rules. The ATF and DOJ have jurisdiction over FFL holders not the department of state. My FFL is from the DOJ and signed by the ATF. My inspections are done by the ATF. If the DDTC showed up to inspect me I will tell them to get off my property.

I think you should . That will give us the answers we want . We could start a fund for you to do it . Let us know when? Larry
 
Given all the talk about the fee will there be any gunsmiths willing to stay in business? My main guy on Florida told a fellow shooter he was calling it quits. When will the registration fee go into effect? Is there a grace period for current work to be finished? If I had a barrel and receiver ready to be assembled I would sure like the smith to be able to finish the project that was started way before this new FFL requirement. Has anyone asked the ATF these questions? Will anyone ask these questions.

Could a group of smaller gunsmith operations become responsible persons (RP) under one FFL, pay a prorated share of both the 2250.00 fee and the FFLs liability insurance, and stay in business as a group? Why wouldn't that work? There are buying groups for weapons and ammunition, why not for gunsmithing? There is a provision for many RPs on the current FFL application. Why not form many gunsmithing consortiums and stay in business? I do not believe the new regulation states anything about a business consortium of gunsmiths working under one licensed LLC.

Has anyone asked if this would be possible with the AFT? How about the NRA, I am sure they have lawyers and creative minds to explore alternative business models.

What do we do next..... Give up and stop target shooting?
 
The best plan is to put as much heat on this as we can. The NRA needs to grow a set and fight this in court so we need to start flooding them with calls and emails and demand they fight this. That is what we pay membership fees for. Demand they put a class action law suit on this and stop it in court. If they say they cant they are full of it because organizations do it all the time when they want to stop a wolf season in Wyoming. Put as much heat on your representatives and on the NRA, DDTC, NSSf and this will be stopped. It worked for the green tip 5.56 ammo ban it can work with this. The other thing people forget is that a small shop like mine located on my residence would never get insurance if I was now considered a manufacturer and if I did it would be to the point where I couldn't afford to pay for it. I had a hell of a time just finding liability insurance since my shop sits on the same property as my house and I live on 8 acres in the country. This will affect everyone from the steel mines, barrel makers, tool and die makers, machinery manufacturers and so on if this is allowed to stand.

This is clearly an attempt to put the small guy out of business and slowly pull guns out of peoples hands. Now is the time to act by writing and calling congress men, senators , state dep DDTC etc. If you aren't an NRA member become one, if you are make someone else a member out of your own pocket if you must. Failure to act is giving away your rights, now is the time to act spend some forum time writing and calling if you don't act kiss your guns goodbye because they are coming for them this is just a start.

Yes this is my first post I usually come for info on loads and calibers but the day has come when my gunsmith can't re chamber my gun and I am pissed I hope you are also. Now get off your asses and act or you don't deserve guns!

Called my gunsmith tonight. Asked him to do a simple crown and maybe cut a couple inches off a barrel. Informed -

"OUT OF BUSINESS!"

He told me his gross in a year would not pay for that license and fees. Sadly, he is now stopping all work. That means my Dashers and other rifles are orphans with no support. Simple stuff, like a barrel cut and crown - forget it. If this is the case I am seriously handicapped with anything more than just using factory hunting rifles.
 
For what its worth, I just got an email from NSSF and they are fighting it. They are the first ones I have heard of that is actually putting up a fight. I talked to the NRA and the guy I talked to acted like he did not care.
