ITAR Registration -- Plan on Paying your Gunsmith more...

Hi Dakor,

Your ATF office is giving you their interpretation of ATF rules and regulations. The new ITAR regulations are issued by the Department of State and their guidance is what matters in this regard. If you ask the ATF office how ITAR will be enforced, I am sure they will respond "not our juristiction."
Homeland Security is the State Dept blue uniforms.
 
I would like to know that, too, Gary. I would write them a letter telling them why I'm ceasing to buy their products.


I asked who and all he could say is there was a driving force in the firearms Industry he would not name names. The man I spoke to was very informed on this order and knew what he was talking about. He was also very polite and did not like the Idea of the DDTC going through a class action lawsuit and believes that they are going to be thrown under the bus for this order by the firearms Industry and the ATF even though he said the ATF main office in DC was given the order before it went out and was OK with the DDTC sending it out.

As to the comment about the ATF agent and voting democratic that is what he said I did not bring up politics he did and why is it so far fetched to believe that is how he feels? Just because he works for the ATF does not mean he is a mindless robot.

I spoke with the executive director of Gun Owners of California today. He reinforced that we all need to call or congressmen and the DDTC and make a big stink. He says orginazations like the DDTC HATE to get bombarded with calls like ours and it makes a huge difference. The phone number to the DDTC :)

This is so much like the Federal Government bureaucracy, the left hand has no idea what the right hand is doing and it stinks to the heavens'.
Making up onerous rules and regulations that do nothing more than single out individuals and their business that have NO actual benefit is just depriving people of a lively hood and to be heavy handed. What on God's Green Earth do they hope to accomplish with such nonsense other than to TERRORIZE those that work on firearms to the point of stopping for fear of arrest and fine. This has all the overtones of a Hilter type manuever.
The ATFE its a lot like Jake, it's always been a leaky vessel.
There, I feel a bit better now.

Interesting, wonder who in the industry?

Just follow the money. I'm sure there's a long list of corporations that will profit from shutting down a bunch of small independent gun smiths.
 
I called the DDTC and spoke with a Compliance Specialist Supervisor. I was told that the firearms industry asked for this ruling and I was also told this was ran through the ATF head quarters before it was released. So plain and simple you are completely legal with the ATF and Illegal with the DDTC. Now anyone knows a good lawyer would have a field day with this in court and everyone knows that a good lawyer is not cheap.

I called the DDTC this morning and talked to a gentleman named chuck( I forget his last name). Long story short he said the NSSF was the main group asking for clarification on the DDTC rules. Chuck also said that the NSSF did not reply to this new letter ( 22 c.f.r. 122.1). So the DDTC left it a lone.

I also asked what good does it do to register as a manufacturer if you are changing a barrel. He said "so the government knows who is doing what".

Another thing he said was that this is a living document and can be changed. He brought up it being changed to exclude gunsmiths from having to pay the fee.

IT IS STILL BS TO HAVE TO REGISTER!

I believe the best strategy is for us to put pressure on the NSSF and the NRA to challenge the DDTC on their interpretation. If Chuck is being truthful, then it sounds like the NSSF dropped the ball. Regardless, it sounds like there is an line of communication in place that perhaps can straighten this out.

These people all have a vested interest in maintaining a functioning firearms industry.

The Chairman of the NSSF is Robert Scott, who is the Vice-Chairman of Smith and Wesson. The Co-Chairman of NSSF is Stephen Hornady, who is the President of Hornady Manufacturing.

If you want to have the DDTC ruling amended, put pressure on these gentlemen. Here's a link on how to contact Hornady.

We have to be very careful about changing this thing. It is my understanding that once the process to change the Constitution gets approved, anything and everything can be changed by majority of political vote.. In the times we are in, I don't want to think about what that might mean, but I get your good intention.
