And just like that new prosecutors look to revive the case. The prosecutor who had been handling the case is also a state legislator. Late in the game a lawyer pointed out something that was apparently overlooked. There is a New Mexico that does not allow someone who is a member of their legislature to act as a prosecutor, which left that person with a couple of options, one of which was to step away from the case entirely, which would require the appointment of a new prosecutor, or in this case prosecutors.
Strange how all the experts are trying to figure out how a pistol goes off when your holding it in your hand and pointing at it at someone. I thought the Guild rules were no ammo allowed near the movie set. They were shooting target practice in the desert nearby the day before, probably with the same pistol. The guild requires a fiewarm safety person. The set gun safety person was incompitant. I heard someone say how do they find a safety person. Do they just grab someone and say your the safety director with no firearm experience. Sounds like many people on the set knew the rules and didn't care. You can block the barrel and still fire blanks. Why was he handling the gun when it wasn't required for what they are filming. Heard it was a low budget movie. It was brought out that in many movies now they have guns that are totaly disfunctional. They add the sound of the gun during editing.Good for him. He killed her.
So many things wrong. But even a child could have prevented what happened from happening.Strange how all the experts are trying to figure out how a pistol goes off when your holding it in your hand and pointing at it at someone. In any other world away from Hollyweird, the person who held the gun, pointing it at another person and firing it, would be neglecting the most basic principle of responsible gun handling, that we should assume every gun is loaded. If this was me, I'd already be serving my sentence. Sad, and I understand that it took other circumstances that may have been someone else's fault but none of that changes the FACT that he held the gun and neglected the most basic principle of responsible gun handling...period. It was his responsibility to check that gun...nobody else's. Even if they had someone with that job title, it doesn't change the law and it doesn't change the fact that he was negligent. Sad, yes, but mostly because it was very preventable. So many things wrong. But even a child could have prevented what happened from happening.
I am the only one that touches my revolvers. When I take one out, I clear it just to make sure. I trained my brain to do it... always. Even when I know no one has ever even touched it.
The real shame is that it is really a big deal and they are trying to BS an excuse as to why he really isnt at fault. There should be extra charges for even attempting to BS your way out of it.
