In Kansas if you have a concealed carry licenses, show your ID fill out the 4473. Out the door you go no phone calls. Like the old days.

some places do the Nics check with computer, so you mite not see a phone call but i think they are doing it. I notice places around here that sell bigger volumes of guns and you do the 4473 on computer, I dont see them make a phone call but the NICs check was done .

US DOJ just sent out a letter to all ammunition vendors (and perhaps FFL's) in CA clarifying that, despite recreational dope use being legal in the state, a "yes" answer to the question "have you been prescribed, or do you use marijuana" should be an automatic prohibition when it comes to firearms or ammunition.

No. It has to do with attempts to weed out crazies. Not that the state would have the expertise to make that evaluation and not that they need expertise, their view is that the desire to own a firearm is evidence of mental illness.

This is true, my son has his FFL and just received approval to do NICS checks over the internet . I am not sure how long this has been available,but I remember buying a gun in VT a few years ago and the seller did the web NICS check on me .

We had a person come in to the store about a month ago to buy a handgun, he filled out the form and checked yes to being a felon and to hitting his wife. The department manager happened to be the one doing the sale and as he checked over the paperwork he got the "you must be kidding" look on his face. He asked the guy are you sure you want to turn this in? The guy says sure why not?
The manager had to explain to him that #1 we were maybe a mile from the local O.S.P. office, #2 He was a felon trying to buy a handgun, it took a minute but the light finally came on and the guy said no and we tore up the form and he left. Go figure.

Is that a federal rule or a state rule? I think state but im not sure so ill check around here. Mine was issued after 2010. thanks

that is true but I always thought the NICs check is a federal law. I didnt think the states could elect not to do it when a firearm is purchased no matter if someone has a concealed permit or not. Mabie the federal law says some states can though. something i gotta find out.

If the states' background check is as good or better than the Feds' (NICS), the Fed may defer to that state check for sales. CC permit may or may not be relevant, again it takes the Feds' approval for CC permit to be used in lieu of the NICS check.

Florida runs their own system,FDLE, Texas if you have a CC Permit you still fill out the 4473 but there's no check.

That’s coming! One thing to note: While I was sitting on a park bench in Aspen Colorado, I noticed a store that had that “leafy” sign in the window. A kid came out and happened to sit down close enough to me that I could ask a question or two. I asked him if they asked for ID. He said they did. I asked if they just looked at it or recorded it. He said they “scanned it” into their computer. I was going to ask the kid if he hunted, but he left before I could.

I know a guy with multiple felonies that got his chp here in NC.
They don't go back more than 7 yrs he said.
I don't like it that he can own one when I had to jump through hoops because of a ex wife complaint 10 yrs ago

This is why( For the most part ) back ground checks are B.S. It is one more way for the anti second ammendment bunch to restrict gun ownership.

I'm gonna be the Devils advocate here..
If its "recreational marijuana" I can see them logging and documenting purchases and who the purchaser is.

Now if its "Medical Marijuana" there this thing called "HIPAA laws" just like the guy taking precipsion opiates. Its medical and is private.
Any disclosure of any medical information or use of medication is illegal.

Now let's talk about discrimination because a person decides to use a "NATURAL" medicine versus "prescription".
Prescription drugs are synthesized and made by man with a shitload of side effects including death.
Marijuana is a natural medicine with 2 major side effect....
1- A person might get a lil sleepy
2- Said person will probably f@{k the refrigerator up!!

Now if a person is a believer in GOD, then he should also believe that GOD created all living things, including "Marijuana".

I personally have someone very close and dear to me that uses "Marijuana" as a medicine along with various other homeopathic medicines to combat the neurological disorder called "Dystonia", versus the psychotropic drugs prescribed with side effects of uncontrollable urges for gambling, and sex, and strong desires to not live anymore, and the possibility of DEATH.

OK, so a quick read tells me (which is not necessarily correct) that they are making the request so as to be able to look for records involving mental health incidents. It is pretty vague though.

OTOH I wouldn't be surprised if that verbiage (or similar) was in every states laws, though.

I would have to believe for the states to take it on themselves to do firearms sales determinations and back ground checks they have to have a good reason. And I dont think its to keep the Feds out of our business.
I think States want to limit more buyers than the Feds do and generally stick there nose more into whats going on. They are also probably putting all this info in a database so they are basically registering all guns sold that paperwork is done on.

No,you still have to fill out the 4473,but the check goes through the FDLE,Florida Dept.of Law Enforsement.
