New CA Law Banning Promotion of Guns to Minors

EMERGENCY ATTENTION FOR ALL MEMBERS

THE CALIFORNIA LEGISLATURE APPROVED ASSEMBLY BILL 2571 AND WAS SIGNED BY THE GOVERNOR. IT WAS EFFECTIVE JULY 1, 2022 UNDER EMERGENCY LEGISLATION. THE LAW NEGATIVELY AFFECTS THE OPERATION OF THE CLUB RANGE.

Basically the State of California passed a law not allowing parents to bring their children to the range to shoot or purchase items targeted, to someone under the age of 18.

[Forum Boss: That is not the express language of the statute; on its face it does not prohibit bringing kids to the range. But yes, the definition of promoting firearms to minors is very, very broad.]

You can look up the Bill. Its enforcement section is under Chapter 39 (commencing with Section 22949.80) to Division 8 of the Business and Professions Code. It authorizes a penalty of $25,000 fine for a violation of this law for “advertising to minor”. IE anyone under the age of 18.

The California Rifle and Pistol Association (CRPA) through their legal representation of Michel & Associates Attorneys at Law indicated that Ranges take immediate action because “the definition of who is part of the “firearm industry” in the language of the law is extraordinarily broad and affects most ranges, retailers, youth shooting programs, associations and potentially individuals.

This was brought up and discussed by the Board and the membership at the Saturday meeting. A tough decision was made. All Junior Shoots, Boy Scout Shoots are CANCELED UNTIL FURTHER NOTICE. NO MINORS ALLOWED AT ANY OF THE CLUB MATCHES OR EVENTS.

The next question was do we allow anyone under 18 years of age onto the Range until further clarification is made from Michel & Associates.

This was discussed at the Meeting. This was a very hard decision to make. The Board (and membership present) concurred that we have to protect the Club. We are afraid the “Broad Interpretation” by the current State Administration could attack and punish the Club membership.

As of July 10th no minors are allowed on Club premises. Signage will be going up as soon as it is printed.

Side note. A Place to Shoot is located on Federal Land. Management there believes the law is not enforceable on Federal land so they will continue to operate normally and allow parents with children to use the Range.

Being located in California, I am concerned about the broad terms of the statute.

AB 2571, Bauer-Kahan. Firearms: advertising to minors.
Existing law generally regulates manufacturers and dealers of firearms. Under existing law, commercial speech or advertising is generally protected under the First Amendment to the Constitution of the United States. Existing laws and regulations, however, restrict the content and placement of advertising and promotional marketing of alcohol, cannabis, and tobacco to protect minors.
This bill would prohibit a firearm industry member, as defined, from advertising or marketing any firearm-related product, as defined, in a manner that is designed, intended, or reasonably appears to be attractive to minors. The bill would also prohibit a firearm industry member from using, disclosing, or compiling a minor’s personal information if it is intended to market or advertise a firearm to that minor, as specified. The bill would impose a civil penalty of up to $25,000 for each violation of these provisions, and would authorize a person harmed by a violation to bring suit to recover any damages suffered, as specified. The bill would make each copy or republication of marketing or advertising prohibited by these provisions a separate violation. The bill would declare that its provisions are severable, as specified.
This bill would declare that it is to take effect immediately as an urgency statute.
 
This definition of affected persons/entities is extremely broad:

(4) “Firearm industry member” means any of the following:
(A) A person, firm, corporation, company, partnership, society, joint stock company, or any other entity or association engaged in the manufacture, distribution, importation, marketing, wholesale, or retail sale of firearm-related products.
(B) A person, firm, corporation, company, partnership, society, joint stock company, or any other entity or association formed for the express purpose of promoting, encouraging, or advocating for the purchase, use, or ownership of firearm-related products that does one of the following:
(i) Advertises firearm-related products.
(ii) Advertises events where firearm-related products are sold or used.
(iii) Endorses specific firearm-related products.
(iv) Sponsors or otherwise promotes events at which firearm-related products are sold or used.

(5) “Firearm-related product” means a firearm, ammunition, reloaded ammunition, a firearm precursor part, a firearm component, or a firearm accessory that meets any of the following conditions: (D) Marketing or advertising for the item is directed to residents of California.

Forum Boss: This means that an advertisement for a sling or a holster could violate this CA law.

(6) “Marketing or advertising” means, in exchange for monetary compensation, to make a communication to one or more individuals, or to arrange for the dissemination to the public of a communication, about a product or service the primary purpose of which is to encourage recipients of the communication to purchase or use the product or service.

I don't want to venture a legal opinion, but this could potentially affect Scout troops, shooting groups, maybe even the CMP.
 
I can't believe this law was actually originally drafted by an attorney.

Imagine that, in order to prevent drunk driving, every car company would be fined $25000 for each instance of promoting a vehicle. And if you made car air fresheners you could be fined too.

A state that reelects the likes of Pelosi and Feinstein repeatedly for as long as they have doesn't surprise me.
Cali is not part of the Republic and hasn't been for a long time.
 
Life as we know it, not only as firearms owner or second amendment supporters but as God fearing, America loving citizens of this great nation. Will soon be over and the sad part is there are so many people out there that just don't get it. This is as politely as I can put this. Shame on all of us!!!!
 
Well what about the Boy Scout marksmanship merit badge ??
My one grandson has finished with cub scout's and went thru
the the air rifle program earning a merit badge. He will now be
able to start the rimfire program, now that he's in the boy scouts.
In our area, they have access to both indoor and outdoor ranges.
Would the Cali law kill that off for the scouts there ?? Sad, very sad !!
 
Could it be California is just trying to protect minors. I have some 100 percent cotton gun cleaning patches that have the warning"this product can exposue you to chemicals....known to cause cancer in the State of California." Lot's of gun cleaning patches at those ranges right?
 
It would seem that this new bill will halt all the various shooting programs that citizens under the age of 18 are now using i.e. trap/skeet shooting, small arms shooting and training programs all over the states, especially California. Also the training and teaching of safe firearms handling and hunting/shooting skills by the Hunter Safety Programs in all states, especially California again.
This is a total shame and does nothing to puniish or hamper criminals and the crimes they commit.
Where is it going to end, with governments infringing on lawful citizens rights ?
 
I live out here in California and a part of local high school trap team got correspondence today saying that it’s pretty much over unless something changes these people know exactly what They are doing and it’s not just happening out here in this state, and the worst part of it is this Jackhole is going to run for president. I knew I laughed when I heard Joe Biden was going to run for president thinking this is gonna be a slam dunk for Trump and look what happened if we don’t think that Newsom can get elected as commander in chief better open our eyes
