If it's the same as hunting below the oak tree line on the rivers here the ruling will not stop land owners from harassing and trying to intimidate you. When you come to the corner have one of the party to video the passage. You may need it later. May years ago before Grady Judd, Polk County was the worst.

I am all about property owners’ rights. That being said, I’ve seen way too many instances where private land owners get possessive of the public land that adjoins theirs and that, I believe, is the real issue with their opposition to corner crossing.

The opinion from the 10th circuit goes into detail. Congress wanted to give the railroads land to build the transcontinental route. The supreme Court ruled that unconstitutional. So by doing the checkerboard the government's sections would increase in value to offset the donation of the other sections to the railroads thereby passing the constitutional test...

In MT sections 16 and 36 were set aside as trust lands to fund schools.

Central East Idaho is like that. I have a good gunsmith, stock work only, friend up there. I have to have him follow me up to public land sections that are great Elk hunting areas. He calls the appropriate landowner, we get thru the gate, and I park my P/U. Then I hunt Elk. If I get one (or not), I have to call him to meet me and get me thru the locked gates and back to the road. Every year. Same gate, same Rancher, does not matter.

I see a young man about 300 yards away in the timber, hiding with a rifle. I drove up to him the second time, and asked him why he was there. He told me, to keep me from breaking the lock and going thru. I was wearing my old field jacket with my Ranger badging on the sleeve. He was unimpressed. I just asked him what he would do if I broke the lock. He said he would perform a citizens arrest. I suggested to him that would not happen in his lifetime. He told me one of his brothers was on the other side of the pasture. We chatted a bit, and he did allow as he would be the first casualty; but I might be the second.
I left him with the knowledge that it would not have been my first rodeo...

Bad facts make bad law. Iffy if SC will take up the case. The a'hole ranch owner got what he deserved. Seriously, claimed that his ranch value would go down drastically if couldn't landlock the public. Waiting for the State legislatures to start passing laws to mandate access to the public lands and the party will be on. The vast majority of the voters are not big property owners and have no time for the bigwigs from out of State that own the prime real estate that blocks their access to the public lands.

I'm not taking sides on either one just waiting for the courts to decide when its completely over, but is it his fault he bought 22,000 acres of checker board land or the gov. for doing it 150 years ago?
I'll bet good money the majority of people had that kind of money would have done the same thing taking advantage of the situation.
