Thoughts on a "Shorty" 6BR

An XP 100 should already be registered as a Pistol. If you purchased it used it should have been transferred thru an FFL. But to answer your question. Yes, it doesn't matter what kind of stock it has. The barrel length is the deciding factor between pistol/handgun or rifle. A rifle barrel has to be 16" or longer to be legal. A pistol/handgun is 16" or less. It is highly illegal to possess a rifle with a barrel length less than 16".
 
So a 14" xp100 bolted in a xr100 or mdl 7 stock is still perfectly legal and considered a pistol reguardless of stock configuration?
 
An XP 100 action "is" a pistol action from the factory. A 14" barreled action mounted on a rifle stock may draw some questions. BUT, it's still a pistol. You might have to do some explaning. In that case, be ready and have all your ducks in a row.
You might find it easier to go to a 16"+ barrel length to avoid any problems. Depends on where you are and who you end up dealing with?
A BATF Agent looking to score some points could make a big difference on how your day turns out. :'(
A short barreled rifle would draw more attention than a short barreled pistol BUT, on the pistol action, the barrel can be any length you want it to be. Just be ready and CYA. ;)
 
Hey guys, I hate to interject into a good conversation here, but a few of you are off track when it comes to rifle vs pistol. The difference between rifle and pistol, in the eyes of the ATF, is whether it is designed to be fired from the shoulder, or fired from the hand. To be legal, if a firearm has a rifle stock, it MUST have a 16" or longer barrel. Any shorter than that and it must be registered as a Short Barreled Rifle, and you must pay the $200 tax stamp. If the firearms is designed to be fired from the hand like the factory configured XP100 or any other bench rest pistol, then it can have any barrel length you want. DO NOT take a factory XP100 and put it in a rifle stock, unless you have filed a Form 1 with the ATF and it has come back approved. If you do not have the approved form and you manufacture a Short Barreled Rifle (taking an XP100 and putting it in a rifle stock is considered manufacturing an SBR by the ATF) you will be looking at $250,000 fine and 10 years in prison. I hope this clears some stuff up, and please do not take any offense to anything I just wrote, it was meant to be informative and not insulting in any way.

PS: I manage a Class 3 firearm (Short Barreled Rifles, Suppressors, full auto firearms etc.) retailer and I have had a good bit of experience with ATF law. I have personally gone through the process of manufacturing and registering an SBR with the ATF. Just wanted to qualify my statements above.
