Rifle to pistol build and our gubmint re XP100

I seriously doubt that will fly for a private citizen. Once again, who's gonna know as long as it's never transferred? But, being a consumer and claiming it was a pistol first, with that fact not being established or of record, you could be on thin ice.

You have a cellular phone? Just take a picture. Yes that is how it works. Some states prohibit this but the fed said it is ok. Granted give them two seconds and they will change their minds. Also burden of proof is on he state not you.

Read the ATF ruling 2011-4. It states the ability to convert back and forth is for firearms originally produced and sold as firearm originally intended to be configured both rifle and pistol. An undesignated action is neither until assembled. Pistol, yes- pistol to rifle, yes- rifle back to pistol, no. Unfortunately we live in a society where technicalities are the final word. If you have an Encore, you can do anything you want, as spelled out in 2011-4. If you buy an undesignated action you fall under the rifle rule.

"IF".....2011-4 has been rewritten I'd enjoy the reg number and would be more than happy to read it.
 
TRA, the last two major paragraphs on the last page addressed my question perfectly in that the original "firearm" had been built as a pistol only, never a rifle. As long as a shoulder stock configuration did not have a barrel or barrels less than 16", it was legal. It can be reassembled into a pistol anytime. Back and forth is OK as long as it has been initially mfrd as a pistol. Interesting reading, 2011-4

However, TRA, I will have to ask you to revisit your rendering of "rifle back to pistol - no."
I interpret them referring to the original manufacturing intent, if being born a "rifle", it can not be converted BACK into a pistol. It never was. So converting a rifle configuration to a pistol is dependent on its birth designation. If born a pistol, a gender swap is fine as long as the bbl(s) are proper length and OAL is met. It can be returned at any time to proper pistol configuration w/o prejudice.

It is so easy to trip over words when trying to render legalise....For me anyway. I can see now I really need that cuppa. Too early to venture any further w/o. Thanks for all of the replies.
 
I keep going back to the "MEASUREMENTS"!! And remember, we're talking about what we are refering to as a pistol. (In this case, not a one handed gun like a revolver, more like a long (longer) barreled rig designed to shoot from a rest)?
If the barrel is at least 16" long and the OAL of the rig is at least 26" long, it's still a rifle, no matter what it looks like!!

I used to listen to them on NPR radio on WAMU 88.5 FM out of Wash. DC. The original Law firm of "Dewey, Cheetum & Howe" was from the Three Stooges. The Tappet Bros. had a lot in common with them.

Ah, another factoid. I didn't know that. However both of the NPR boys had degrees from MIT. They were really pretty sharp. Similar to Tommy Smothers being the brains of that duo.
 
I Remember In The Late 70's And Early 80's That A Lot Of B/R Shooters Were Shooting Sleeved XP-100 Actions , I Guess That Was The Way To Go Or Maybe Just Affordable. I Have A XP-100 Rem. .221 Fireball Barrel, Stock, and Bolt, I Just Need A Receiver To Put It Back To Original, I Believe In My State Of N.J. I Would Have To Get A Pistol Permit.
 
Rather than take a chance, If it's a genuine xp100 action with the same serial on the bolt, not butchered up from machine work, and you have the centergrip trigger, you could sell it to me. I guarantee you I'll screw a 15" barrel on it.
 
Mine will be a 15" barrel threaded for a brake, brake should add about another 1 1/2". It will also have a rifle scope sitting on top of it. Hardest part these days is finding a good stock that doesn't bankrupt you. If I do a rear grip I'll just start with a new in the box 700 single shot action with solid bottom using a Jewell trigger and stocks are much easier.
 
you do know if you get caught with a short barrel that you will have a choice to go under cover in the Aryan Nations or have your family taken out by the Feds,,

Just make sure the action is "undesignated", not a scavenge from a Bass Pro $379, 700 rifle special. Bubba likes fresh meat.
