Pistol transfer ?

Is an FFL transfer (pistol) required for a family member out of state ? This is not a sale but a gift (from me).
 
If you are going to ship it i believe it will have to go to a FFL cost or gift isn't a factor. You also have state law on the receiving end.
 
I should have been clearer . This will be given " in person" as a X-Mas gift. edit to add: This is a pistol I've had for many years (mid 80's) so it's not something I'm buying to give away (straw purchase).
 
You misunderstood. The face to face comment was in regards to ATF regulations. I have no desire to get into the state laws.
 
Why is it when someone asks for advice, they shun it or want to disregard it? You dang well better be concerned about state law since if you take that pistol into a state that does not allow it, you are putting your relative in jeapordy! You received some great advice and if you think it's wrong spend some time on the phone with the AG's office, of the state where the pistol is going.
 
I can travel armed in ALL 50 states legally under the provisions of LEOSA. Law Enforcement Officers Safety Act. As a retired FED I am authorized to carry. Even in New York. But this has nothing to do with the transfer of a firearm. All I was saying was that for Federal Law purposes, you can do a face to face transfer anywhere without an FFL. Federal laws ONLY. Now if some whack job in Albany decides I can't, then the voters either suck it up and roll over, or vote the bums out. Jeeez, the Mayor of New York is outlawing oversized big gulps? Got so little to worry about?

The answer is easy. The OP is looking for someone that has had first hand experience and actually know the answer to his question. Any response to the question that used the words: I believe, possible or maybe should be disregarded. It is the OP's prerogative to filter out the BS and try to get at the facts. Later! Frank
 
In PA, the law is that a face to face exchange doesn't "have to" go thru the backround check and the exchange of registration BUT..... keep in mind that the registered owner is the one to be held responsible for the gun, even once it leaves his hand as long as he is registered owner. I wouldn't care how good of friend or relative is, if I sell or give someone a gun and they don't want to go thru the backround check, they won't get a gun of mine, cause I would feel they they are hiding something and if you can't pass a backround check...You're not to have the gun in the first place!
If both parties are from different states, the law is very clear, it must be shipped from an FFL to a FFL in the other state, which should (by law) be followed by the backround check conducted by the FFL in the receiving state. Gifted or purchased.

Maybe you didn't read the part about hand to hand transfer, in this case there will be "NO" shipping involved. Also I am curious are firearms registered in PA?

As I posted in the first sentence of my reply "a face to face exchange doesn't have to". In answer to your question about registration...Yes, any long gun being sold must be registered when it is purchased from a FFL dealer although the gun show/private party exception is still in effect ( you can still go to a gun show and purchase a rifle without a backround check) But by law all handgun purchases (new and used) in PA are to include a transfer of ownership and a backround check before the purchaser is to be allowed to have the gun.
 
Update: After reading through umpteen pages of BATF regs. What I have seen is that "IF" my Bro shows me His States CC permit No other paper work need be done. I will have him dbl check on his end though in case I missed something. Thanks Dave Berg and Mods (Bulletin Board) for posting the Links. Roger T
