Loaning a rifle to a friend?

Hello,

I have a very good buddy who's moving to Homer, Alaska at the end of the month. He plans on doing some
hunting while up there. I have a Marlin 1895 Gov't 45/70. Is it legal for me to loan him my rifle?

I'm in Nevada. The rifle is registered to me. If I can let him use my rifle, what is the procedure? Do I need
to send it to an FFL in Alaska or his residence? Do I need to include a letter giving permission from me the
owner to my buddy to use/loan to?

Any advice/info would be appreciated.

Thanks.

If you can't hand it to him and tell him good luck an if you break it you bought it, then I'm guessing you'll have to ship it, correct? That can be done easy enough by him locating a FFL Dealer in Alaska, getting you a Tranfer Copy of their License, you either box it up and ship it yourself or take it to a FFL Dealer in Nevada and have them do it.

For a look at a te Federal Laws here's a link to the BATFE FAQ's about such things:

This is the BATFE link for State by State Laws:

Last I read, you can loan your rifle to a person who is allowed to possess a firearm of the type you are lending for a period of 30 days. I would absolutely look at the items forwarded to you above. The problem might be getting it back!

Firearms must be shipped to a FFL holder. Federal law allows you to do this. You could also have your FFL dealer do this. When his FFL holder receives it, it is logged into his books. Your friend will have to fill out a 4473 and fulfill the background requirements just like he bought a rifle in order to pick it up. If he ships it back to you, it works exactly the same: He ships it to your FFL and you must fill out a 4473 and go thru the same procedure as though you just bought the rifle. A letter of permission is not needed as he is now the owner of record as far as the law is concerned; as you will be when you get it back.

I believe if your friend is legally allowed to have a firearm, you can do a face to face transfer. If he lives out of state you will have to send it to a FFL.

Suggest to your buddy to purchase a 12ga pump shotgun in Homer.AK.

You won't want/recognize your Marlin after 1 month in Homer,AK.

Dans40X,
Can you be a bit more specific? What will happen to my rifle if it's up there for sometime?
Thanks.

Thanks all for chiming in and your links and advice. I'll give this some consideration.
I think Dans40X might be the best advice for him just to buy a shotgun...

There are three things in life that you don't loan to anybody...your guns...your chainsaw...your wife and not particularly in that order....LOL ;D

MDslammer,
You loan a firearm to your buddy who has shipping & transfer fee's invested.
Written agreement or not.
He has pocket change invested in his new firearm.
The salt air & humid climate on the Kenia Peninsula of Homer,AK. will render the transferred firearm unrecognizable in a couple months.

Bears aren't a problem in Homer,people are!!

Take it to UPS, boxed up and they will ship it. To anybody, anywhere.

As far as I know, guns are not "registered"

If you trust your friend with it, ship it to him. No problem.

Now, like others, I dont think it is a good idea to loan a gun, but if he is that good of a friend, do it.

You are not selling it, so there is no need to mess with shipping it to an FFL holder.

That's my two cents.

I would NEVER do that. I dont care what you think the law is, its not worth the hassle. I will ALWAYS send any gun action to an. FFL.
