It was bound to happen

I started my company on a couple of bag riders. Then Forum made me a sponsor. Then I never went back to work after covid and expanded into a full line of products.

So, now here is a guy that copied the original bag rider exactly and is selling it on Amazon. Nice. I suppose it was just a matter of time.

The gun world is not imune to guys knocking off others work. Theres always gonna be that guy. I dont see the pride in that work but its a reality.
 
Hi, IP laws are similar by nature in the US and Europe.

If the other company is copying your design in a way that confuses customers into thinking their product is yours, you may have a claim under Section 43(a) of the Lanham Act (false designation of origin). You don’t need a registered trademark for this claim.

Secondly, I would send a cease&desist letter signed by an attorney to the other company. It usually helps, because the other guy will show this letter to his attorney and hopefully will be advised to make a license agreement with you or other kind of deal.
Thirdly, if I were you I would consult and IP lawyer and ask him whether your design qualifies for trade dress or a late design patent filing.

If you were in Europe I would help you out pro bono, but I am sure you will be able to find a competent and cost efficient IP lawyer in the US that will help you out.

I believe that putting anything on Amazon is simply advertising your products to the Chinese. And I believe I'm correct.

Putting anything on Amazon gives a product a type of legitimacy (good or bad). Prompting the TEMU army to dig into the market and flood it with products.
 
There are many innovators in this sport that share their successes, and their failures, and help us all get better and learn more, they advance the sport. There are others that keep their cards close to the chest, and that is their right, and there is nothing wrong with that, their choice. The one instance (there may be more) that I thought was the most disgusting display in all the shooting sports was the spectacle the 22RF smith Calfee made over his big reveal of his accuracy secret. I am not sure he ever really did tell anybody his tricks, but he patted himself on the back trying to make every one guess for years. Thank you to all the guys that share and teach the rest of us along the way!!!!

I've been a calfee fan for years and tried to read everything he posted on his forums. And yes a lot of it was boring repetitive stuff and a lot of self promotive stuff . however once you were accepted into the group he would elaborate on methods and his way of doing thing things. I think a lot of the time he was right in his mind but couldn't explain it in a way that made sense to the more scientific folks. I remember one time he spelled out 10 things he would want in the ultament rimfire action , So I built one from scratch ,I think I had 9 of the 10 things in that he wanted. I hung a lapped (which he taught me how) green mountain barrel on it took it to the range dialed in the tuner and after about 30 min playing with wind flags shot a perfect 1 hole , not 1 ragged hole 1 hole 10 round group at 25 yards. Two days later at a match in Waco it shot a 246 12x on the green monster target. I learned a very important lesson that day-- never shoot in a 1 oclock head wind that cost me two or three points. He explained in detail how he finishes his chambers It's just that most people could not understand his hilbilly ramblings especially when it came to the lard. I wish I could have spent an afternoon on the porch with him yacking about guns but alas that will never happen. however there will always be a bottle if ale 8 on the shelf in the shop as a tribute to the guy that shared some of his secrets with me. And yes he did at times drone on and on about nothing but that was just Bill. No matter what anybody thinks about him he built some killer .22's
