I saw this as well. The good news to me is part of the logic they used. In the Fox News story they said the court noted that it would criminalize half the magazines in the country. Realize this is the Ninth Circuit Court.

If that logic holds it will make it hard to ban ARs......

I hope people realize why this upcoming election is so important. The main reason the left is freaking out and doing what they are doing is, because one thing the news is NOT covering. Trump not only has been placing conservatives on the Supreme Court, with one more to come of he gets another term. But he also replaced half the 9th circuit with conservatives. Till now, it was the most liberal court in America. Hundreds of conservative constitutional judges have been placed in the courts in the last 4 years which will impact this country for generations to come. This coming election is more important than the first term because of this alone.

The decision wouldn't have surprised me too much, except when you see where it came from. Not what one expects from the Ninth Circuit, even with the "improved" membership we have today.

Don't be gloating too much folks, if Biden and Harris get into the White House, they will make this a federal issue and really push to ban more than just high capacity magazines.

So politics is politics. Becerra will try everything he can to make the ban stick but I am thinking he likely will not appeal to the supreme court. Right now it appears he has lost. I'm not a lawyer but I think the next step is for him to either appeal or request an "en banc" review by the entire court. It isn't clear to me if the stay that he asked for 3 years ago applies to this ruling or not, I'd think not but others are saying it is still in effect. So I'm waiting to see what the legal wheels bring next. 3 years ago with a similar ruling, Californians mail ordered millions of high capacity magazines that continue to be legal to use (as I've been told).

The reason I speculate that it will not be appealed to the supreme court is that with a conservative majority now, Becerra will expect to lose there too which would pretty much put a stake in the heart of the magazine ban. Right now gun rights activists would like to see it go to the supreme court but you can't appeal when you win.
