You no longer get a physical stamp, it comes in the the form of a electronic form with the picture of a stamp on it. It's all done through the atf.gov e-form system now. Approvals are running at 210-215 days. Until suppressors are taken off the NFA list, your buddy is misinformed. Big brother is used to getting 200$ for each one sold. No way they are giving that up!

SO....There was discussion in Texas (not sure if it has passed or not) that a resident of Texas can purchase and use a suppressor so long as it was made in Texas and is only used it Texas. There would be no need to pay the Feds the Tax Stamp Fee or register it with them. Texas is claiming States Rights.
Haven't heard of any other State claiming it has the right to do the same.

There are enough cases of the ATF raiding individuals for making suppressors without the correct paperwork. Your friend is playing with fire. He may get away with it for a time but if he attempts to sell one then he will be in the ATF's crosshairs. I believe that you are still required to fill out a form 1 if you make your own suppressor and a form 4 to sell a suppressor. Someone please correct me if I am wrong.

Texas has eliminated the Texas ban on silencers. There is anti-commandeering clause, as well as the setup for a Federal test case on the commerce clause.

No matter what individual states do, they can't prevent the Feds from enforcing the Federal law. The Texas law prohibits local law enforcement from taking part in arresting or assisting the Feds and when it comes to suppressors. This is dangerous ground and I would not like to walk on it.
While I applaud any and all of Texas's big F U to the federal government, NFA is still national and not state regulated. Federal laws override state laws. I'm sure anyone in Texas who decided to start making and using illegal suppressors would be getting a visit.. The ATF can be a very nosey bunch. And they work against us, so i'm not sure it's in anyone's best interest to even consider this.
Also don’t know anyone who knows anyone ever who has tried this out in Texas - the general consensus is that it’s semi-nonsense, but hey if you want to be first go for it , I’ll watch
It's a shame law. Sounds good and probably got this politician some votes but not valid in any way. Would Texas be responsible for your bail and representation in the court of law? I can guarantee you'd be extradited to a black hole in Virginia so that Texas officials cannot support you for breaking the federal law. I’m thinking of all the states that made pot “legal” while it’s still illegal by “law” in the Fed’s books. Same scenario as the Texas suppressor law. Now, isn’t it strange that the ATF is threatening Texas but the DEA is silent on pot?
I recently heard New Jersey made 23 million $$$ on pot tax in the first month of legalization. It’s always a case of “follow the money”!
Been researching this, guy tells me that bill sb1098 has passed as law in OK. That any suppressor made in OK and used in OK in legal manner is not required to have atf approval.

You might look at the history of the “Montana Firearms Freedom Act”.
It worked it’s way through the system and basically died when the Supreme court refused to hear the case in 2013. So yes, it’s been tried, maybe Texas has a new twist.

Why not? Don't let the process steer you away. My only advice is: Don't be in an hurry to posses it. Pick one, pay for it and then forget about it. When you receive it in 8-10 months later, you'll be happy you did ; )
