Fedex and firearm theft

My wife had a new iPhone delivered a few years ago by Fed Ex. When it arrived, the box felt a little heavy and someone had switched a machine part for the iPhone. Apple made it good but we get them from the store now.
 
I will say the the supervisor I finally got to speak to at the distribution center was the most cordial and spoke English. He said he was a shooter too and did everything he could do on his end. He recommended reporting to sheriff, which I did. They too were nice and followed up, but a bolt action Sporter is not high on priority list compared to other more pressing crimes not too far from DC. Fedex is no different than any bureaucratic agency today. I am returning to USPS and have had issues years ago with damage but at least they ask upon receipt of goods and they must conform to federal law.
 
My local FFL can ship guns usps, even hand guns, cheaper than fedex or ups, and he only charges $20 plus the shipping. Interestingly that makes the theft a federal offense and the P.O. still takes his claims seriously. To me it makes sense to use him rather than risk it myself.

Had a FFL ship a long arm USPS fully insured. It was a custom rifle. Long story short, they would only reimburse based on the price on the receipt of the retailer. I purchased the rifle in thw 1980’s. No original receipt. The value of the custom work was irrelevant. My story had a happy ending because the rifle showed up two months later. If I had to pursue the claim it would have been ugly. I don’t insure via the carrier anymore. I think I stand a better chance with my firearm insurance policy.

It’s been a few years but it looks like FedX policy has changed. I had a pistol recalled by S&W for safety issues. They sent me a FedX shipping label and instructions to take it to FedX, boxed up. The FedX shipping clerk looked up the ship to destination as being an FFL and accepted the package. Three weeks later a FedX truck pulled up and returned my pistol, after I signed for it.
 
What a bummer on losing the money and worse, a fine firearm.
I’m going through something similar on a smaller scale. Bought a box of bullets from a guy on LRH. He sent them through the usps priority mail. He did his part. After over a week and doing some tracking, I found out that my post office delivered them to the wrong address a few miles away from me.
Mail carrier claims she has tried contacting those people to no avail. Was told to pursue a claim through the PO website. What a royal PITA ! They don’t make it easy to file a claim, that’s for sure. I’m not holding my breath….
It’s a crime when they sell you insurance and tell you that you’re covered and then basically tell you to pound sand.

Same shit happened to me. I shipped a 500 box of Berger bullets and 300 pieces of new Lapua brass to DJs brass. The box arrived all wet and only contained about 150 pieces of brass and zero bullets. It was sent USPS. I still think someone there decided to help themselves to the contents. I’m pretty sure a 500 box of new berger bullets is going to be fairly obvious when it “falls out” of the box.

Contacted them again today to at least get a return on my shipping charges and insurance. Attached is what they sent. Too bad that they did not advise on my original online shipping information. Insanity. FedEx willingly took legal possession, AND committed to a contract to honor the insured value in the event of damage/missing/theft. But you're to blame? Because they declare you shall not be allowed to ship, yet they accepted it for shipment?

I'm wondering what the "fine" (read: indecipherably small) print said, regarding their claimed requirement you be an FFL shipper.

I suspect a small claims court would be sympathetic. Contract law and all.

Unfortunately big business has lawyers. Everything is stacked in their favor. Frankly FEDEX is very busy and the don't care about this problem. In fact , it is probably part of the plan.
 
I went thru Hell 6 months ago. Sold a Rifle tried to ship to FFL with Copies of FFL in Hand.
Fed-X and UPS sent me Packing ...

I was told ( If) the FFL Dealer sends me the Label and I put it on the Box?
Just lay the Box on the Counter and walk out ?

Now if You have a Account and Print a label ! What goes on Now ?? Just Thinking !!!

"Big" attorneys or not, I suspect that with undeniable facts they'd have difficulty surmounting a claim made in court, having a disinterested third party hearing the claim and seeing the proofs. Wouldn't take a ton of time, and seems about the only way that any traction will be gotten. Short of the CEO of that company giving a rip about outright rip-offs and breach of contract by the company.
 
I bought a pistol off GunBroker about 4 years ago. Seller was an FFL and it was shipped to an FFL for my pickup/transfer. Even though the seller was experienced in shipping firearms and was well versed in how to package them the package the pistol was in mysteriously opened in the Kansas City, Kansas USPS shipping hub. A Postal Inspector contacted me and finally after about a month the pistol was sent on the rest of it's journey to my FFL. No explanation was ever given as to how the package was opened or why it took a month for the shipment to resume.

After that experience I will only consider firearms shipments from an FFL to an FFL. It's not worth the potential financial loss and headache to save a few $$$ in my opinion.
 
The sheriff department just called me and said they have recovered the rifle in the woods in a nearby county in Virginia. They are going to test and see if used in a crime and return to me if not. Unfortunately my pristine condition L46 is rusty.
 
After my experience from trying to set up a new account with FedEx for an FFL I would tell everyone that they need to become very aware of the policies of these companies. They made it very clear to me they weren't interested in any new accounts unless you are going to be a corporate account. They've made it incredibly difficult to become an FFL shipper if not impossible. The privatization of shipping is a direct and attack on the second amendment and the vendors that provide goods to gun owners.

People better wake up to what's happening. The privatization of all of these companies and their open war on the second amendment is not going to go away it's only going to get worse

Not a firearm but a $1300.00 headlight sent to me from a parts dealer didn't show up the dealer sent a tracking number for Fedex they stated it was delivered at 10:17pm on a Friday night nothing on the drive alert or barking pitty security, shipper sent another light good for me but I doubt they will be reimbursed
 
I am an FFL dealer but had the same thing happen to me with FedEx. I had paid the insurance for the value of the gun. They kept denying my claim so after the fourth time, I filed suite against them in small claims court for the value I had insured plus court cost. They settled out of court for the full amount. I would do the same if I were you. Even though your rifle has been found, I would sue for the lost value.
