I am sure AB will be named in the wrongfull death lawsuit(s) but I do not believe he will be charged by the NM AG.
Maybe reading the State statutes on "Negligent Homicide" would clarify things for you , just a bit . Falls under the old John Wayne movie line . "Your fault , My fault , It don't matter" ! A careless act , resulting in the death of another human . N-E-G-L-I-G-E-N-C-E- ! He was negligent for not checking the gun , himself . And lack of proper training , or He's a "Actor" is not a justifiable in defense in any courtroom .

I realize the last thing this thread needs is another post but I saw this today and found Matthew McConaughey's statement below interesting.

While making a point that he wasn't criticizing Baldwin, McConaughey said he "personally would try to always take even more steps" as an actor using a gun, including checking it himself.

"You hear 'cold' — now I want a visual," he said, explaining his own set checklist. "If you and I are in a scene together, I need to give you visual. If it's a six-shooter, do you see light through all six holes? Let me look you in the eye, you confirm, and you yell it out, 'cold.' You can't over-confirm it."

The current investigation is probably looking into whether someone put a real loaded round of ammunition in the revolver while it was sitting unattended on an open cart.

As much as I dislike Alex Baldwin I don't think this was his fault. This was a movie set where a gun was being used as a prop. There were multiple people who were considered experts or competent persons whose job is to make sure the prop is ready to be used by the actor. Loading the correct ammunition is the responsibility of the expert or competent person. I don't think you could reasonably expect the actor(s) to check the condition of the ammunition/prop every time the expert hands said actor the prop for each and every scene/take.
My flame suit is on....

I only have one question regarding this incident. Why do they call a fully functioning revolver a "prop gun"? Doesn't prop gun imply that it is not capable of firing?
I think the Hollywood commies need to convince themselves their glorified violence is just "art", so they call real firearms props to help justify what they do.

In the Godzilla v. Kong movie where they are carrying the white M16s with the ACOGs those came through my shop when I still had my gun shop. I can assure you those firearms are real with real select fire guts. The ACOGs are as fake as Kamala's cackle.

It's easier to make a real gun than a fake one...

If you pull a gun from a holster, cock the hammer, aim it at person, pull the trigger on them, and they die from a projectile leaving the barrel of that gun, it's your fault.

Wanna bet?
Morally, yes it is your fault.
Legally, in this particular instance, no charges will be filed.
Alex will not get charged.

There are universal guidelines, in writing, for actors and screen workers alike, that are essentially the 4 cardinal rules of gun safety. If he doesn't get charged with negligent homicide at the very least, it's because of the two tiered justice system, and a miscarriage of the law.
