Ones mans story of sending a gun to Calif

DONT EVER DO IT !! The buyer has to wait 10 days. The buyer has to go buy a Hunting Lic before taking custody of gun. However there is not Legal hunting with a .22 in Calif. Buyer has to pay taxes because it was insured for $2000. The Gun shop Charged 80.00 to transfer because he did not buy the gun from them. Gun shop said the gun was sent illegal because of no FFL papers. UPS would not had to pay for any Damage if there had been any.

And that Attorney General of Calif is running for Vice President ... GOD HELP US ALL !!
 
as far as Calif. laws, yes they are bad, but leaving is not as easy as some of you say, "Just leave" not that easy. it's either a hunting license or a firearms safety card, I pay $50.00 to bring in a long gun. the 10day has been in effect for a long time.

I am pretty sure you are required to send ffl papers when shipping a firearm anywhere. it is a federal requirement, your post makes it sound like you didn't. are you sure you want this out in the public?
 
Those are actually better than CT laws. You can’t even buy ammo here in CT without a pistol permit. :)

Not sure where you got this tid bit of info from but in the 'real' US of A a long gun has to be received by an FFL but it doesn't have to be shipped by one. Never has! When I had mine I understood handguns to be FFL to FFL but now I understand that only to be true for USPS to ship a hand gun?

I never said it had to be shipped by an FFL. I said you are supposed to have the receiveing FFL paperwork included with the shipment. I have shipped hundreds of firearms including handguns as a private party to an ffl. it may not be a fed regulation, but every carrier i have used wants to see the FFl paperwork once you declare that you are shipping a firearm. that is a fed reg.
here is the quote from the law.
"federal law requires that the carrier be notified that the shipment contains a firearm"

These restrictions you guys from our “progressive” states post should be an additional warning to the rest of us concerned about our potential future.

My FFL says that taxes are only collected on new guns, not on used guns. I don't know if he is right or not, but from now on all my purchases will be used guns, if you know what I mean.

I had a gun shop send it for me.
 
My FFL says that taxes are only collected on new guns, not on used guns. I don't know if he is right or not, but from now on all my purchases will be used guns, if you know what I mean.
All my transfers were purchased used guns, or guns gifted to me. The transfers were straight forward, no big deal.
 
I recently sold a gun to a member of this forum in CA and everything went very well from my perspective. I’m not sure what kind of pain and suffering that he may have endured on his end though.
 
You better find another FFL to deal with. The one's in my area of the new Commie State of California are still doing the handling, reasonably priced and with no hitch's. They just follow the DROS and Fed/state laws on the transaction.

I am just guessing here, so don't get mad at me if am wrong, but in Kaliforina incoming firearms from an FFL must have a doj approval letter. ready for this, you don't need one if the transfer is from private party to ffl. only ffl to ffl.
I'm guessing your guy didn't get the stupid letter.

here's the law

California Penal Code Section 27555 prohibits all Federal Firearms Licensees (FFLs), other than Type 03 or 06 FFLs, from shipping firearms to a FFL in California unless, prior to delivery, the FFL intending to deliver, sell or transfer the firearms obtains a verification approval number from the California Department of Justice Bureau of Firearms. This includes transfers that occur at gun shows.

The CFLC system validates a California FFL’s active status against the California Centralized List. CFLC will generate a Firearms Shipment Approval letter including the verification approval number, if the intended California FFL recipient of the firearm shipment is properly licensed and listed in the state’s database. If the intended CA FFL recipient is not listed in the state's database, the transaction will result in a Do Not Ship letter, and it is a crime for the intended recipient to receive the firearms (Penal Code Section 28465).

Only if the buyer is under 21 years of age (assuming long gun. Under 21 cannot purchase a handgun.) I've been shooting for years, and have never had a hunting license (though that may change soon.) I've bought quite a few firearms.

Buyer has to pay taxes on any firearm coming into the state (unless state sales tax was paid to the dealer.) Tax is on sale price, not on insured value. Chuck may be right on the new/used thing; I've only bought used from in-state (which implies sales tax has already been paid, so is not collected.)

The Gun shop Charged 80.00 to transfer because he did not buy the gun from them.

The shop I go through has a $35 transfer fee (to cover the time and costs associated with paperwork, storage, and record-keeping.) The state has a $37.50 fee for generating a Dealer Record of Sale. Other shops may charge more or less for the transfer fee depending on their wishes. The state gets 37.50 per sale (which may comprise multiple firearms.)

Not sure on this, but I believe a handgun must be shipped FFL (registered with the State of CA) to FFL (in-state.) Rifle may be shipped from private party to FFL (again, I think); but it's up to the receiving FFL as to whether or not they want to allow it.

UPS would not had to pay for any Damage if there had been any.

Then what was the purpose of insurance? Lost shipment only? That makes no sense.

In any case, it sounds like both parties were operating without an understanding of what was required. Not all that surprising; I'm not 100% clear on what's required, either. Which is why I go through a shop with experience doing this, and let them sweat all the details.

Thats Exactly what I did, Took it to a gun dealer who said they have shipped to CaliF before. Figured they know the Law better than me. The point of this post is to take it under advisement. So as to help or advise other members on this board in the future...
