Question about suppressor purchase

I’m wanting to buy a suppressor and was told by someone to form a trust and purchase it in the name of the trust. The reasoning was that I could have members of my family in the trust and we were all able to be legal users. Does anyone have any guidance/ advice regarding this?

And not only that, if something should happen to you, its the trust that owns it and doesn't have to go thru the paperwork and expense to put it in one of your heirs name

Yup, spend the extra $ and have it owned by the trust. Otherwise your heirs would have to apply for a tax stamp all over again.

If you buy it without a trust then NOBODY else can be in possession of it without you present and it can't be passed on to anyone upon death, I believe it technically is supposed be destroyed upon your death. With a trust, anyone on the trust can be in possession of it and it belongs to the trust, not a person, so death of any one person in the trust makes no difference in it's ability to be passed on or possessed.

Yes, the trust can own as many as you would be able to purchase. Any trust member can use/be in possession of a suppressor owned by the trust. You must add the persons you wish to be part of the trust onto the document either when it is formed or as an addendum later. Just being an immediate family member does not make them a member of the trust. Trust me on this.

If you want others to be able to use your suppressors without you there the supressor needs to be owned by the trust and they need to be trustees.

I have cans on physical trust, individual cans, and done cans with the silencershop single shot trusts. The SIngle shot trusts are my favorite. They do all the paperwork for you, and you can add responsible persons that can possess the can later after everything is approved just like an”normal” trust.

The big benefit is when you go to buy your 4th 5th or 16th supressor you don’t need all those people to do a 4473 and fingerprints For every supressor you add like when you do one big physical trust. Since each supressor has its own trust you just do yourself and then add responsible persons later on with a quick trip to a notary if you decide you want someone else to be able to use it.

yes as many as you want, but everyone on the trust has to fill out all the background info (4473) submit pictures, and fingerprints for EVERY can you add to it.


To clear up some stuff,

if you have an “individual” supressor it can be passed down to your heir by designation in your will. They will have to submit a form 5 to the ATF which is the same as a form 4 but is FREE and usually much faster, once the form 5 is approved your heirs take possession of the NFA item.

You’re still the responsible person on your trust so the background check is still on you, and every other person in the trust

In my case it's not worth the extra money for a trust,no one to leave it to and told my wife where to go to get it destroyed.She don't shoot at all.

Im saying to do this in theory youd form a trust, do the background checks for each individual, trust is then established then apply for a tax stamp for each item to be added then wait for the stamp and do a transfer thru an SOT.

Check with your dealer to see if he has a trust already established that you can use. My dealer has one made by his lawyer. My dealer chargers$50 to use the trust form. All you do is add in your info and it's good to go. One of the problems you can run into if you don't get one from a lawyer that words the trust correctly is, the atf will scrutinize the wording of the trust form and may possibly kick back your app for wording that is incorrect within the trust. I believe they must be a legal adult. So yes they would have to wait till of age
