What would you do?

First let me say I have not contacted the scope maker as of yet.
I have a Weaver T46 that is one year old and has already been returned for repair once, the elevation would either not move or it would jump anywhere from a 1/2" per click or up to 1 1/4" per 1/8th inch click. No rhyme or reason, and Weaver said there was nothing wrong with it.
Well now this scope will not hold any point of aim, in a 10 shot string I had holes all over a score target ( 1 Section) this is with a proven 6BR load that with a T 36 was holding shots of the same load in under 0.250 at 100.
Now for the real question would you ask for a new replacement, a refund, or have it repaired and dump it with full disclosure of it's history?
 
I would take the scope off. Then centre the adjustment. Then get a friend who can shoot to test it for me on their rifle. Then if they get the same result I would take the matter up with Weaver.
If on a different rifle with a different shooter the scope is ok then it's time to look at other aspects of your set up.
That's what I would do, no doubt others here will have other ideas.
 
Peter I went one step beyond that, I removed the scope put the T36 on the gun and proceeded to put 4 shots almost in the same hole. So I am sure it is not the gun, the load, or me.
 
Had a similar problem with Leupold. Ended up returning it 4 times. The shot group wouldn't move no matter how many clicks I put on it. Then it would jump way over/under the target with the last click adjustment. Leupold kept saying there was nothing wrong, but kept replacing things. After the third time I returned it, the crosshairs would rotate with each round fired. After the fourth return, it was finally fixed but I got rid of it. I will never purchase another Leupold p.o.s. again.
 
For what it's worth, a shooter whose judgement I trust had exactly the same problem with his weaver fixed power, and exactly the same response from Weaver. click click click jump, basically.

If it were mine, I'd sell it as is while disclosing the problem. Take your lumps and move on. It's tough to get a scope fixed when it's really broken when so many guys are sending back perfectly good scopes.

Are you the original owner of the scope?

Send it back. Tell them about the failed repair and ask them to replace it with a new one. Above all, be extra nice when communicating with them. That usually will go a long way.
