Trouble with exporter

I have two custom rifles and 7k dollars that I paid in advance at a store in Miami. It would be to buy projectiles and NF competition riflescope .. But they are in financial trouble (I believe) and are not wanting to delivering the material. I asked them to return the money and send it to another store in Miami that is authorized to export. But they are not doing what I ask and not paying attention.


*** I had done business with them before, no problem.

I had even bought plane tickets and reserved hotel to go to the US to bring the material to my country. They knew that I would go 3 months in advance, but I only learned that they did not have the material in the store (except the custom rifles, which are paid for, I personally dealt with the gunsmith and he sent it to the shop) because I called two days before Travelling. If he had not called, he would have been out of the woods. But even so, I had a loss of $ 2k in plane tickets and hotel.

Being a outside USA customer, what can I do to not lose everything?
 
You need to have your "legal representative" walk through thier front door and take possession of as much of your property as possible. Most good lawyers know a few Police Officers. Good to have along to show you're serious. If a Company is teetering on the brink of collapse and Bankruptcy, you need to act FAST!!! Good luck. Josh
 
I have a friend who lives in Miami who has offered to go in person to see whats is happening.

I´m not sure if they have financial troubles, but whats more can be?

We are a group of passionate rifle shooters in Brasil, but all custom rifles, bullets, riflescopes, etc come from USA, as we dont have this kind of products here.

Call the DAs office in Miami. The amount constitute grand theft.

I really did not expect to come up with such extreme measures, but I've heard of more people(shooting fellows) in my area who are in the same situation as me.

This particular shop/FFL Exporter just moved a few days ago to another location in Doral / FL area.

I wish you luck, too. I'm not sure I would have given them a "heads up". Surprise attacks put your opponent at a disadvantage.
 
I do not believe they treat American customers that way. As few are willing to bother to export( licenses, fees, etc) we have few alternatives. And they take advantage of it. My friend who lives in Miami even said he thinks it's a matter of disorganization and not of dishonesty. But this has caused a great loss to me.

Therefore, I am no longer interested in knowing the reason for this attitude. If they consider that it is not worth exporting, then they do not accept orders. And dont take the money..

He would need a power of attorney to act in your behalf, and if a firearm is involved then ATF regs are going to get goofy over this one.
 
I was thinking about this also someone is going to go through the registration redtape, which brings the straw dog point up. this is a sticky situation at best, then you throw the international thing in and its more of a mess. Liseo I hope this works out...George
 
Lieso I hope these folks makes this right not only is it costing you money and time but the damn stress it puts on you.Good luck getting what is yours.
 
From what you've written, its sounds like there is definitely something going on which you may not be aware of. Whether its' financial or even possibly legal issues, you need someone (whether a Lawyer or Private Investigator), to determine what's going on. If that business files for Bankruptcy protections or goes out of business, you definitely need to get on a list of "Creditors" so as to be able to recoup part of your loss, should they not deliver any of what you paid for.

In any case, don't let up or give up. Call the local Law Enforcement agency in which the business resides and see if they have active cases or complaints against the business. Also check (or have someone check) the Civil Filings in the Court jurisdiction of the business for active cases involving frauds, Civil Suits or Bankruptcy recently filed, that are active or even settlements against the business where the Courts have ordered payment. And if you find such Orders, correlate the date of those orders to the dates you ordered your goodies. That to be able to establish either Criminal or Civil fraud on their part by showing they took your money to pay off their debts, etc. Then you'd have a strong case which either the local Jurisdiction (Police) or even the local DA's Office could use in either a Criminal or Civil filing in Superior Court and that would help to recoup your loss (should they continue to fail to deliver your goods) via a "restitution order" by the Court.

Good luck and keep the faith. May take some time, but it beats sitting around waiting for the worst to happen.

As a non resident alien you are NOT the defacto owner of these weapons as ATF regulations prohibit foreign persons from owning and possessing weapons and ammunition on US soil . The FFL owns these weapons until the export is authorized by the US State Department. You cannot send anyone to look the weapons because the FFL does not have to answer any questions reguarding these two weapons. Where exports are concerned, all transactions are based on trust. Trust from the part of the importer to pre-pay.

At best, you may have motive for a civil suit. But that would mean hiring an attorney. Nonetheless the attorney would require copies of your import documents and the amount stated on these would have to be exactly what you are claiming you paid for the weapons.

The information above is based on experience. We are a US State Department registered manufacturer and exporter as well as an FFL and do this for a living.

I believe you don't know Liseo. He lives in Brazil. He has an exporter that handles the USA part for him and he has the proper people to receive it for him. He is aware of the law and how to properly import it to his country.
He was only wanting to know how to deal with the USA supplier.
