Sales Tax...

I had a local FFL try that on me for a $$ rifle. He didn't even get the transfer fee. He's also a VP at the gun club.

If Amazon charges state sales tax, they do it if they sold the product. If someone else sold it, and Amazon was only the fulfillment agent, they don't collect the tax.
One of the best reasons I don't/won't bother with transfers. For the $25 fee charged in this part of the country and the possible sales tax related hassles from the state, why bother? As mentioned a couple of times already, most states actively enforce their sales tax laws on anyone holding a resale or manufactures tax permit, and most are as complicated as federal tax law is.

I should have stated that the rifle was coming from out of state to Florida. In this case, I would pay the use tax (6%) directly to the Florida Department of Revenue. Inasmuch as the local FFL didn't sell the rifle, he does not collect sales tax on it.

Sorry for not painting the whole picture.
 
If you file NYS income taxes there is a line for paying sales tax on out of state purchases. If you fail to and get caught, I guess, you would be guilty of tax evasion. Amazon and private sales cost the states millions in lost sales tax.

Not trying to argumentative here but if my state of Idaho never had something they can't lose it. They may want something and not get it but they can't lose it if they didn't have it in the first place.
 
A FFL dealer can only do any transactions. From his place of business .

If the FFL Has the product in his invtory he must charge sales tax to a buyer . If is just a transfer he doesn't .
Guns can only be transferred from the designated place of business .

Wow that sucks. In ND there is no tax on services.

Because sales taxes are state mandated taxes. Every time you register it, you pay the taxes for that state.

Most consumers don't realize that they owe taxes on anything they purchase if their state has such a tax. Just because you buy online, you don't get a pass on the taxes. Also just because your state does not actively collect these taxes, you are still obligated to pay them. It's a catch 22 situation that can get very expensive to get out of if you get caught.

In my state, Ohio, you have to have a vendors license to do business. All that is, is your permit to collect sales tax and forward it to the state. I don't deal with consumers as my customers are tax exempt, therefore I don't collect. If I were to do business with a consumer, I would then be obligated to collect the taxes.

So if I were to have you perform a service for me and I refuse to pay you, you'd be ok with that? Think about that for a while. We all have to pay.
 
I went through a state tax audit several years ago. You'll never gues what the auditor's very first question from her mouth was..."Sir, do you subscribe to any magazines?" It turned out fine but that question was fair warning that she meant business!

I wouldn't put much faith into thinking you are getting off easy, not paying sales tax. You, all of us, are paying no matter what the terminology is. Everyone pays.

let's not go to obammy care costs. My wife retired two years ago in April. She had only taken three days of sick leave in twenty-eight years with the state. Enough to convert to health care to cover to within a month of 65 and Medicare. Enter obammy. Her premium has gone from $420 a month to nearly $620, and November 1st it goes to $700.

And its not just sales tax. A friend of mine was buying cigarettes mail order. He got caught and had to cough up over $6,000 in unpaid tobacco tax. I moved to Louisiana from Chicago with a lease car. The sales tax was built into the lease payments. Louisiana wanted to tax me on the blue book value of the car when I tried to register it. They supposedly only give you 6 months to transfer registration. I left it registered in Illinois and just turned it in at the end of the lease. And people have been challenged when they show a bill of sale for a boat or car that is well under book value. Then you have to have it appraised and show it is worth less or pay tax based on the book value.

I now own anything major, boats, planes and cars within L.L.C.s that I have in Delaware a state with no sales tax, but I do have to pay $350.00 Delaware Minimum Corporate Tax and $99.00 a year for my registered agent as well as $36.00 a year to have the mail for those items forwarded. About $500 in total, but on big ticket items it can pay especially if you change them frequently and you get the added limit on liability.
