Marking barrel cal.?pics added

Sprayed a cutoff flat black it shows up better for the pics. Either way with or without the dark barrel the result looks great.

Don't take my word for it. Call ATFE and tell them you, as 07 licensed manufacture, will be taking a Rem./Win./Mauser and installing a new barrel, stocking it, and making other alterations to build a complete 'custom' rifle that you will sell and ask what, if any, you are required to do as far as 'marking' it. They're more than glad to answer questions. Don't take it wrong, but I don't take alot of what others post on forums as 'gospel', either. I check it out for myself.
 
Probably had a FFL a day or two longer than you. Even though I'm a 70yr old Okie, I use the Dallas Batf office. I don't take stuff that I read on the net as gospel all of the time, just part of the time. I just looked over 113 of my rifles. Only a very few have a location and MFG company names on them. Most have serial numbers, but not all. Being as old as I am I can say it was a recent thing to require a serial number. Most all of my Mausers have serial numbers. It was not because Germany required it, It was a way to track their own weapons. How many custom rifles have you seen where the 07ffl marked their name and location on either the receiver and or barrel?
I have a very nice custom AR15. The only markings on it is Stiller MFG and his serial number. Nothing is on it that has a thing to identify the person that built the upper. He has built several hundred or more uppers per year. He doesn't even need a FFL as he only does the upper.
 
This isn't my first rodeo either. I've been licensed for 20+ years. I got my info straight from the senior field agent ,out of OKC. This was at a ATFE Training/informational Seminar I attended. The Dallas District Director was right there, too (OKC is a satellite office of the Dallas/Mid-South district). She didn't contradict the senior field agent. This info was presented, first to the group of approx. 250 and then I got the same question answered "one on one" from that same field agent. You find it hard to believe that new or existing regulations are now being enforced? There have been new regulations written and old ones that were not enforced being implemented daily in most every industry you can think of. Oil/Nat. Gas/ Coal, banking, car makers (emission & fuel stds.), health care, immigration,,,,,, the list is endless. As for the guy building uppers, he doesn't need to be licensed, unless he handles the lower in any way. For firearms with no serial number, I'd bet they were made prior to 1968, when the GCA was enacted. Same for no Mfg./location markings they weren't required until the GCA of '68. Have I seen may custom rifles with the makers trade name and city/town and state on the arm? Yes, I've seen quit a few. I've seen more that do not. I've seen plenty, just here lately, with no caliber designation. I, also, know of many who are building rifles (and providing the receiver) that are operating with a 01 Dealers License. If ATFE discovers that is the case they will insist you get a 07 Manufactures License. And then, there seem to be quit a few lately who operate with no license at all, strictly on the "buddy" deal. If I was a licensee reading this, I think I'd call my local ATFE office and ask questions. I wouldn't take my word for it and I wouldn't take Butches'. Get your info from those who will, at some point, be doing a compliance inspection on you/your business. There is a hugh amount of info concerning manufacture that doesn't make much sense, but, it's enforced none the less. And yes, the German government required serial numbers for tracking. That is why the current marking regs are what they are,,, for tracking. There is a reason most barrel makers will install one of their barrels on your action, but, state they do not provide actions (I'm thinking Hart, Krieger here, and most likely some others. Check their web sites!) Installing a barrel on a customer owned action is a gunsmithing task and requires a 01 license and a lot less paper work. If, on the other hand, the licensee provides the action he is considered the manufacture, no matter whose barrel he puts on it, and, 11% excise tax is required for 50 or more. 07 Manufacture requirements/regs are much more complicated than having a 01 Dealers' license, I have had both. I started as a 01 as a sole proprietor, when my business became a LLc, which required applying for a license all over again, and the field agent that came for the pre-license interview discovered I was building rifles and providing the actions occasionally, he insisted I be 07 licensed if I wanted to continue business as I had been.. It's been 4 or 5 times the paper work! The result has been follow the rules and regs or ??????? Much more than I had ever intended to post in this thread. Think what ya'want, get the straight info from those who will be doing a compliance inspection some day. (they try to inspect manufactures at least every 5 years. I've known of dealers who have gone 15+ without an inspection)
 
shortgrass, Are you telling me that a 01 and 07 are required to mark something with the name and address somewhere on the weapon if they re barrel, restock, and do other work to a customers rifle?
 
Shortgrass, here is something to ponder. I have had an FFL since '76 and have had conformaence checks from time to time. I am mostly a cutom gun builder and was told during one check that if I rebarrel and action "...I am changing the aspect of the firearm..." Well, after some discussion, they decided to review that statement. They cam back in two weeks and did a complete turnaround. The bottom line, If you own the serial numbered part, do some work on it and then sell it, you are manufacturing! I have that in writing.

Now for the important part, I was a civil service employee for over 30 years. In all that time the things are learned are, one, nobody wants to take responsibility for anything; "it ain't my job". And two, there ain't any two supervisors or department heads who can agree on or interpret the same rule the same way.

Like Butch says, the only part that needs to be stamped with a specific depth is the serial numbered part.
 
Butch, the customer is the "manufacture" if he supplies the action/rifle to use for a 'build' or a simple re-barreling, no marking required (common sense says mark the caliber on the barrel). If I use my 07 to buy a Rem. 700, dismantel it and build a rifle using that action, I am the manufacture,,, marking required. If a customer comes to me and orders a rifle using either a custom action or one of the more common RemChesters, and I order the action and do the work, I am the manufacture. Gundoktr,, how long ago did you get that info? Things change, 'ya know, any time there's a change in administrations. I received this info 5-2012. When it comes from the district office (Dallas, in this case), that means it originally came from Washington. They would not have presented seminar/training without direction/OK from above (it meant more than a day away from their duties and travel expenses from Dallas to OKC, they used a college lecture hall, don't know if there was any expense there, or not). Even if it is "the two dept. heads" thing (and I doubt that it is, I'd say this came from DOJ),,, these are the people who will inspect my business and everyone else in Texas and Oklahoma and whatever other territory they are responsible for.

This is your original post. So according to your post all folks have to mark all the stuff posted by you? He asked about a rebarrel or did I read his post wrong. I read his post a couple times and didn't pick up him saying he bought a rifle or receiver and built a rifle for sale. Did I read this wrong?

You read it wrong! "Marking my barrels" can mean several different things, Butch. It could mean he wants to mark his barrels when he has finished a complete custom that he will sell. It could also mean that he re-barrels some for himself and wants to put the caliber on the barrel so that it looks nice! He is not specific, either way. That means he could , #1, be working for himself,,,,, #2 , be doing gunsmith work with a 01 Dealers license, or #3, be building/barreling as a 07 manufacture. I posted so that if he is operating as a 07 Manufacture, he would not buy equipment that would not be suitable. He asked for "Any and all suggestions". I'm done here, if all you want to do is nit-pic! As I have better things to do!
 
so for my peace of mind id read the regz, a couple of times then contact my nearest agent for his inturp. this was one of the more entertaining posts ive read lately.puffin up your chest wont keep any of us from fines or jail. i know a few who regularly drink(a lot) and drive without recourse but that dont make it legal. as a non 01 or 07 holder i do not presume to know anything pertaining but cool heads and research will prevail in this area im sure.
