We make constitutional arguments, when we should be making inalienable rights arguments, not constitutional rights. They are inalienable rights secured by the constitution, state and federal. The basis of any inalienable right is established in the Declaration of Independence, and the document clearly states that "We hold these truths to be self evident, that all men are created equal, that they are endowed by their Creator with certain inalienable rights". Look for the mention of God, or inalienable rights, in the Constitution. Our Constitution is a U.S.A. belief, not a global belief. Life is a gift of God… not an inalienable right. The "creator" of the rights we enjoy, were the founding fathers of our Constitution. God did not intend for us to be robots, but in fact, free to choose. The power of persuasion is a mighty tool.But the 14th Amendment and the Constitutional case law based on the 14th did not. Essentially, before the 14th Amendment, the states were pretty much free to do as they liked. The Bill of Rights only limited the Federal government's power, not states'.
