Stupid legal question. How can the "new" Morphing Fractal Engraving Vise Jaws be Patent Pending when the old antique from 1913 exists and may have been patented itself? Isn't that "prior art"? or whatever that patent term is.

I ran into vise at an estate sale and was intrigued at its design. So it ended up following me home. But there is no casting numbers or manufactures plate on it so I have no idea who made it. The quality is very good. But what makes it unusual is that the hardened "jaws" rotate to grip oddly...

I buried this deep in another post. No response and I am curious to know more. For instance, who might have made this. Are they common or valuable. It seems handy. I forgot, I had it and never clean it off and tired it out.
