ffl question

I am thinking of putting some firearms up for sale on the internet. my question is how do you fellas that have done this in the past verify an ffl? should I ask for the buyer to mail a signed copy to me or is or is there another way I can verify an up to date license I do not wont to get sideways with the atf thanks dave
 
I definitely ask for a copy of their FFL. It is a common request and many can and will email you a copy. You should keep it with a copy of your Bill of Sale just in case. Take it with you when you ship - sometimes the clerk at UPS or USPS ask, sometimes not. Be sure and over pack it. Had more than one barrel end up poking out one end of a box before.

+1 on this....An extra 3 or 4 layers of cardboard on the muzzle end in the shipping box is an excellent and necessary idea. I don't know how shippers seem to handle or throw boxes with long guns in them, they must practice, but the muzzle end of barrels unless really padded, seem to find the weakest spot and come through.
 
I take my firearms I sell over the internet to my FFL and he transfers them for me. The peace of mind is worth the cost.

Get the buyer to send a signed copy of his FFL with the payment.
 
Today the "ATF" frowns greatly on the sending of a copy of the FFL. They "Today" tell new licensees not to send a copy of there FFL to anyone other than another FFL holder.

They do want private sellers to verify thru "fflezecheck", and of course you as the seller can only ship to a Valid FFL holder, that is the purpose of the ezecheck web-site. The seller does not need and there is no requirement for any private seller to have a copy of the FFL, and what are you going to do with it after you get it? How long are you suppose to keep it? Is someone going to ask you for it? At some time are you going to have to prove that you had it when you shipped?

I as a private party can only ship directly to an FFL holder,if I do not receive a copy of an FFL license I will not ship the gun,simple as that.

I want a copy for my records so if there is any questions I have the document with a name and address that I shipped the rifle to.

I see your point, but Hombre is right...

As long as you verify the FFL number on the ezcheck website, send the item. There's no reason to have a copy of the receiver's FFL. For piece of mind, you can print the verification from the ATF website, and include that in your shipment.
 
Phil, That's fine with me and I understand were you are coming from and agree to a point. I have had discussions and attended a meeting ( with the ATF in attendance) were this subject was the point of the meeting. In that meeting the ATF would like to see all transfers of "ALL" firearms be done only between FFL's. That would mean that you as a seller could not ship to a FFL as an individual, you would be forced to go thru a FFL on your end as well.

The problem they have is that is not what the law says--At least not today!!
The ezecheck web-site was put there for the verification of a FFL and no hard copy is in the mail or whatever way you use to get the FFL from point A to point B. Makes a lot of sense to me also.

Today there are many FFL license holders that will not accept a firearm from a non FFL holder. They do that because the ATF is telling all FFL license holders that they do not "Want" them giving there copy of the FFL to a non holder. Today you can do it either way, but what about tomorrow?

The ezecheck is very simple to use, there is no waiting for the license to be sent. And no matter how you feel there is no reason for you to have a copy of the FFL license for your records or any other reason. If it gives you a warm and cozy feeling that's fine with me.

Now with that said and the only reason I posted on this thread, is to dispel the false idea that the seller of a firearm in a private transaction must have a copy of an FFL license to ship to. That is not what the law says plan and simple. The law does say you "Must" ship to a legal FFL license holder. If ATF forces us to follow the letter of the law, then as a seller you must verify that the piece of paper in your hand is valid. Without some form of verification you simple do not know weather that is a fact or not. That is what ezecheck is for.

Is there a regulation prohibiting FFl holders from supplying a copy of their FFl to someone? Or is the ATF just makin up rules to suit themselves as they go..

Zilla, Let me take a stab at this. There is "NOT" a regulation prohibiting a FFL holder from supplying you or anyone else who is legal to own a firearm a copy of there FFL. There is also no regulation stating they "Must" furnish you with it. It is up to them. More and more of them today are choosing not to furnish one.

I, for one will not provide a copy of my FFL to a non-licensee. But, I will provide the relevant numbers of my license for an E-Z Check. (E-Z Check doesn't require all of the license number.) I think a bigger problem exists when the person who ships doesn't want to provide I.D. so that I can complete my bound book. No complete entry, no transfer. Thus, I don't do transfers anymore.... Too much hassle for $25.

As stated before, this site will check validity of an FFL for you. If it is out of date, they will indeed tell you. I would not give out a complete FFL, especially if doing business at a home. No need to tell everyone where you store the goodies.

Maybe it's a problem in your area. Here I used the same FFL holder all the time.. I do have a copy of his FFL on my phone in PDF format. If I purchase and need a weapon shipped to him all he requires is a heads up. As a non FFL holder I fail to see the problem .. The weapon has to be shipped to the FFL holder on the form. The he does the required BG check. If there is a problem he can always turn it around and send it back.. I have been doing this for 7-8 years and have yet to have or hear of an issue..
