ATF form 4473 (NICS check) Questions

The first 4473 forms ask if the firearm was a "long gun or a hand gun". The present form asks for the make, serial number and the cal/ga. That sounds like firearms registration, and I thought the SCOTUS ruled that unconstitutional. I also remember that the forms 4473 would be purged periodically.

I checked with the NYS Troopers to see what form they were using for their NICS check and was told the ATF form 4473. So, I guess that means the Troopers have a list of the exact firearms I have purchased and will never be purged, just check on your DWI 20 years ago. When did the law (form 4473) get changed or am I dreaming .... again.

Long story short, that info was on the previous 4473 as well. Just on a different page, always filled out by the FFL. The only info that gets transmitted on the background check is the type of firearm. Not the make, serial number etc. There’s no true “registration” like most people think. It’s kept on file by the FFL and goes no further unless the ATF has probable cause to track that firearm.

But the FFL can purge them after X number of years, I think it's 20.
I've run 1000's of NICS checks, done 1000's of 4473's. The nics check only asks handgun, long gun or other (just a receiver). Yes, the make model caliber & serial number are on the form, but NOT included in the NICS.

Stupid facts. They are never as dramatic as the story they refute.

My LGS sends me a video every time he is shredding one of my 4473's that is 20+ years old. Here in Montana, if you have a concealed carry permit, they don't call in for approval.

I have wondered why the change in location. The paranoid thought based on recent directions...... it is easier to scan the front page to digitize the information.

OK, you are saying the 4473 has the make, model, and SN filled out by the FFL holder (gunshop) but that is not transmitted during the NICS check and is retained by the FFL forever. NY State, in its infinite wisdom, has the NYS Troopers doing and keeping the NICS check paperwork replacing the FBI. It is stupid and deletes a working program. My paranoid mind says The Socialist State of NY and the Troopers are up to something and I doubt it is good.
