New developments - got the weaver rail off. I think now I can find a thin profile picatinny to drill/tap/mount in the same way.

Yeah, a bit nonstandard. However it sidesteps a lot of issues. Its not like the weaver rail setup was standard and it clearly didn't hold the PO back...so I'm not going to sweat it.

Quick update to close the loop on this...

I ended up getting a custom picatinny rail made from Murphy Precision. They did a great job and machined the new rail so I can mount it the exact same way as the weaver. Took me less than 10 min to bed/mount.

The setup with the picatinny is about 1/8 inch higher than a true flat top, but considering the cost was less than a new side charging upper no complaints! I also avoided having to grind away the barrel's extensions to match the m4 feed lips that would be present in a new upper.

Murphy Precision was very good to work with.
