Here in Delaware, a couple years ago, the regulators gave the OK to use straight wall pistol cartridge firearms for deer. Some went and bought ARs in those cartridges and hunted with them the first year. The black gun anti-s in the department of natural resources decided to bypass the state constitution, existing hunting legislation and banned them. Two organizations and two private citizens filed suit to overturn the ban and won.

On Wednesday, November 17, 2020, Delaware Superior Court Judge Noel Eason Primos handed down his long-awaited decision in a case filed by the Delaware State Sportsmen’s Association, the Bridgeville Rifle and Pistol Club and two individual members challenging DNREC’s interpretation of the law passed by the General Assembly allowing pistol caliber rifles using straight walled ammunition to be used by Delaware hunters during specified deer seasons. As a result of this decision all semi-automatic rifles, including America’s favorite sporting rifle, the venerable AR-15, chambered for straight-walled pistol caliber ammunition and that otherwise meet the requirements of the statute may now be used to harvest deer in Delaware. DSSA, the Bridgeville Club and the two individual members filed this suit after DNREC declared all semi-automatic rifles illegal and unilaterally declared that only ammunition meant specifically for existing pistols would be allowed. The Court found both rules to be contrary to Delaware statutory law and the “regulations” to have violated the Administrative Procedures Act. The case was filed in November of 2019. We thank the many members and supporters who contributed to DSSA’s Civil Rights Defense Fund to help pay for the costly legal expenses arising from this litigation. But please take note that this decision is brand new and that DNREC may still decide to appeal the judge’s decision to the Delaware Supreme Court – this case may not be over.
