SCOTUS Tosses Mexico's Claim Against Gunmakers

The Supreme Court on Thursday tossed out a lawsuit from the Mexican government that alleged American gun manufacturers should be held responsible for cartel violence on the Southwest border, a decision that shields the companies from a suit that had claimed billions in damages.

Justice Elena Kagan wrote the opinion for a unanimous court explaining why the Protection of Lawful Commerce in Arms Act, which allows suits to go forward if they’re based on an underlying violation of a state or federal law, doesn’t allow the suit against Mexico to proceed:

“Mexico’s complaint does not plausibly allege that the defendant manufacturers aided and abetted gun dealers’ unlawful sales of firearms to Mexican traffickers,” Kagan wrote for the court. “We have little doubt that, as the complaint asserts, some such sales take place – and that the manufacturers know they do.”

Only the extreemly uninformed would belive the mass sales of illeagal weapons could be stopped by a wall! Most cargo planes dont stop for walls, and you can be assured that is how the vast majority are transported, and likely never on a registered flight!

Thieves crooks and criminals do stupid chit, and are of a very small number, cartels are as advanced as most militaries.

All the lib judge said was Mexico didn't show the judges actual evidence to support their allegations. But she believes the allegations are true, that manufacturers know their products are sold illegally.

Which is probably true. But the Court found that Mexico ignored the important fact that S&W doesn't sell to the retail dealer or consumer and has no control over the end sale. It would be like suing a car manufacturer for damage caused by drunk drivers.

Of course. Anybody with half a brain knows that the manufacturers of firearms have absolutely no control over the end user, no more than Ford can be held responsible for someone using a Ford vehicle for a drive by shooting or the commission of any other crime. It’s ridiculous.

Booze is sold illegally, cigarettes, prescription drugs and on. That's a fact of human life. Because the gun maker know it, its not their fault unless the continue to sell to a distributor they know is violating the law
