Issue Sighting in Rifle w/ VX Freedom 3X9X40 350 Legend

Scope: Leupold VX Freedom 3x9x40 350 Legend
Rings: Leupold Open Range across Slot Rings- Low
Rifle: CVA Scout TD V2 350 Legend
Ammo: Winchester 150 gr Deer Season XP
Scope mounted and boresighted at point of purchase. Shot at 50 yards, 6 inches low and a little right. Got it dialed and moved back to 100, low and a little right. Dialed in and then started shooting about 6 inches low again, consecutively. Went back to 50 and same issue. Resighted and same thing happened. Tried on 3 separate occasions with the same thing happening, Elevation seems to eventually revert to where it was after bore sight.
Called Leupold and they said that the elevation is maxed out. I'm a hunter, not a precision shooter so some of the explanation was over my head but he pinned the issue on the mounts. He recommended Burris Signature Rings as I can make adjustments at the rings, or a temporary fix of shimming the back mount with two pieces cut from an aluminum can. New to the CDS Dial, I don’t get how it can be maxed out if I can still make adjustments. Leupold said it’s maxed so adjustments won’t hold after recoil.

Thoughts on how to remedy this situation?
Window to hunt with this rifle this season is closing so I'm leaning towards just sending it in and having it resolved for next season. But should I still consider new mounts, or something else?

Plenty of options out there for scopes that work as they should.
 
Could be a scope issue, but could also be a mount or rifle issue. If the scope is not broken somehow, then Burris Signature rings with the offset inserts should solve the issue.
 
If I hadn't seen this in the past I wouldn't believe it. Run the dials to both extents several times and then return them to mechanical zero (basically count clicks from one extent to the other and then go half). My friend had a newly built AR with a Leupold and was attempting to sight it in. His impacts were right by about 3 ft at 100 yards. I kept telling him to dial, he would and then hit the same exact spot. I finally got asked to try and I shot and hit where he did. Turned the dial a full turn and it did nothing. So I then turned it one way and somehow it never hit a stop. I turned it the other direction and after several turns it stopped. Turned it back the other way and this time it stopped. Went to mechanical 0 and shot, impact was 2 inches left. Dialed it to compensate and it hit the bullseye. It was repeatable after that but completely confusing to this day.

The correct answer is stated by Gary above, but this may correct your immediate issue.
 
If it is not a scope problem, then "sending it in" won't fix any thing. Try turning the elevation down a turn to get it away from "maxed out elevation" per the Leupold rep. See if it will shoot a group. If so change it a little more down and see if it moves the impact down more. If it does then do a quick shimming job or get some Burris rings with the insert.

Optically center the scope and shoot at a big target at 50 yds If you are off by feet figure out the problem and go from there. Burris Signature rings may be the solution. Good luck.
