Home Invasion

I wonder why the homeowner was so heartless! He never offered him some Pepto Bismol for his apparent upset stomach! Terrible! :o
 
At first I thought it was a set up then reading the news article it appears the man did it and was crazy after repeated attempts by the apartment dweller arming himself and actually shot the sob.
 
The moron is lucky the guy used a pistol, I would've been waiting with 12 gauge semi.

That door was something else, I didn't know they could be so flimsy.
 
The first mistake to defuse the situation-

Upon entry,the first shot should have been to the head,followed by two shots to the heart & lung(s).

A corpse tells no LIES!!
Case closed.

How in the world could ANYONE argue that shoot wasnt justified? The crazed idiot busts in your door after you yell at him to stop and that you have a gun and that you will shoot him. Frankly, I think the homeowner didnt shoot enough and got luck the couple shots he did fire seemed to hit their target and put him down, mostly. You can hear him yelling at the guy to stay down as he was apparently trying to get back up and get to him again. Sorry, but I would rather not be hacked up with a machete so I think unloading on the crazy guy is perfectly ok in that situation.
 
Remember this fellas, when someone bent on some violent criminal activity is assaulting either you, or your family, whether in your home or out in public, he has ZERO regard for the law, you or LIFE in general! You probably do NOT know him / her and you have no idea of his mental state. There is a REAL possibility he is T-Totally psychotic or with a drug induced psychosis, or just an evil person. In either mental event he is VERY dangerous.. If the person is only wounded and caught and found to be "mentally incompetent" by the criminal justice system, he may very well seek to retaliate against the "person he perceives made him go to prison" and seek retaliation when he gets out..

Having said that, if I need to employ deadly force to stop an attacker, I will "not leave any unfinished business". If you can legally use deadly force, then USE DEADLY FORCE! I can attest, as a retired Lieutenant from Houston P.D., NO POLICE OFFICER SHOOTS TO WOUND! You shoot to "stop the fight"! The "rule" I live by is that I will NEVER leave any unfinished business at hand! OBVIOUSLY your state laws need to be observed. More "liberal" states may take a different view than Texas does>>>so OBEY the laws of your state. BUT I can not think of ANY state where where IF you are defending your life, whether in your home or not, will not have laws allowing you to use deadly force in defense of life! Ergo, if you employ deadly force>>use DEADLY force>>or you may live to regret it altogether!
 
There are fine lines in each individual state. While police officers are permitted to use deadly force in certain circumstances when attempting to enforce the law, it is illegal for private citizens to use deadly force unless it meets the SPECIFIC requirements set out by their state in circumstances of self defense or defense of another person.

Know your state law before embarking on that journey!
 
In new York forever you have to try to retreat if possible secondly if someone trys to follow you into or is breaking into to your home he has to have a weapon of some sort to use deadly force. If he runs out of your house wounded you are going to jail . Then they swarm your home and take all your weapons and getting them back is costly if they don't loose them.
 
I'm not a lawyer, but here is some free advice.

1: You are never shooting to kill. Never. No matter where the muzzle was pointing. You are shooting to stop something that you believe is a threat to your life. You quit shooting when that threat stopped.

2: Don't talk to anyone before talking to a lawyer. At the very least, it will give you time to think about things and not say something in a manner that will,get you in hot water.

3: Remember that there will likely be a civil suit even if you are not charged with anything criminal.

Take that for what it's worth. My opinion and $1 will get you a large soda at Mickey D's.
 
Years ago when I was living in Houston, I helped the HPD bomb squad with some testing of a water cannon. Became friends with several of them. One of them told me "If you have to shoot someone who is breaking in to your place, keep shooting until he's dead, drag him inside, and call me". ;-)
