Gun Trusts

I am working on getting a surpressor. During my investigations I was told to look into getting a "Gun Trust". Has anybody went this way? lawer?? Internet? What avenue did you take too accomplish it?? I understand the why.
 
It's actually a pretty easy process. The first thing you need to do is find a lawyer who can establish the trust for you. I can't recommend one or another and I don't know where you are locally, but I know that many have used Apple Law Firm, in Jacksonville, FL. If you do some searches, you can find some write-ups on them. Alternatively, you can do some searches for local lawyers that specialize in gun trusts. I am not specifically recommending anything, but this site (http://www.guntrustlawyer.com/) was useful to me in finding a lawyer to help.

The process itself is pretty fast - you need to decide what name you are going to use on your trust (hint: keep it short since you'll have to engrave it if you build an SBR) and who the initial trustees will be.

The cost can be anywhere from $300 - $600, based on what I have seen, and once you talk to the lawyer, depending on who you are working with, the paperwork will only take a few days to complete. They'll send you the documents, you review, sign, and have certain portions notarized, and you are all set.

One thing they'll likely recommend is to establish a business checking account for the trust, that is separate from your personal accounts. Apparently, it keeps a cleaner paper trail although you *can* use personal funds. There's just some extra paperwork involved.
 
The ppl you buy from can set you up WITH a person that can set you up with a trust. Unless the person you buy from also happens to have a JD and licensed in your state, they cannot set up the trust. Be careful folks, as you are messing with NFA toys that carry a hefty penalty if you mess up.
 
^^^^ THIS. There are several gun shops in my area that will make you a trust behind the back counter. Unless they are a lawyer as well, THEIR TRUST IS NOT VALID.

So far I have received 5 suppressors on my "Gun Trust" that was typed off of "Legal Forms" on line by a friend of mine and checked over by my "Class 3" guy and passed the ATF's check as recent as 1 month back. You have to be careful that the "Trust" you write up is for the state you live in as state laws on trusts are different and that is where people got in trouble from what I was told by my "Class 3" dealer. The trust is the "Owner" of the firearm or accessory placed in the trust. This is only how the process worked for me.

The ATF does not check the validity of your trust, but if it becomes apparent that your trust is invalid, though, your class three items on that trust can be confiscated and worse.
 
My class 3 dealer set my trust up, then it went through a lawyer. Had no trouble with ATF. I see people at the local funshow setup to do trusts now.
