Any ITAR gunsmithing updates?

Just wondering if anyone has any new information about the ITAR updates Obama signed last July? I'm counting down the days till I move out of my super liberal city (that bans FFL out of a residence) and going to be getting my FFL again to open up shop.

Are most guys still running under a 01, or did everyone have to go to 07? Mainly talking about doing custom rifle work with customer supplied parts, or less than a dozen scratch builds/year.
 
Pay to do business or face prison and or civil fines. Just renewed my FFL and BATFE doesn't enforce DDTC/ITAR but they ask if your registered and give you the Registration information as they also give the TTB information.

I have my FFL renewal application for an 01 sitting here and it says nothing about the ITAR on it or in the packet that came with it. I asked my local ATF agent about the ITAR a few weeks ago and he stated that was for only 07 FFL holders that are manufacturing or importing and exporting. The agent also stated the DDTC has no jurisdiction on FFL holders that are not manufacturing or importing or exporting firearms.

So until I get an offical letter from somewhere saying I have to register I am going on with my day to day life. If it is they way it was made out to be shouldnt a letter be in my renewal packet or the DDTC should send me an official letter right? That would only make sense.
 
Just went through the first compliance inspection from the ATF since getting my ffl 13yrs ago. I brought up the subject of the ITAR registration at the very end of our visit, and was told that I needn't be concerned with it, that it didn't apply to me & my business, which is principally gunsmithing/custom rifle building. I have an 01 license, which I need to renew, and the agent suggested that I change from an 01 to 07. He told me there was no downside, relative to keeping a 01 license. Even though he was very helpful in every way during the inspection, I'm still not completely clear on whether I want to change to a 07, or keep the 01 license. He did explain that if I were to stock a number of receivers or actions for complete builds as a 07, I'd need to engrave my company name & address on them, which I feel is ridiculous. Not seeing any reason why I'd need to engrave my company name on a Remington, Stiller, Bighorn, etc when the company that made the action already has their name & s/n engraved on it.

My personal experience. I was told to go from an 07 to an 01 as this would take me out of the ITAR loop. By law the ATF. is required to visit every 07 at least once every 5 yrs. Not so with an 01. My agent said if I changed to an 01 I would most likely never have another visit as it is not required by law. Take this with a grain of salt as every agent seems to have a different interpretation of the ITAR bs. I see no advantage and possible trouble going to an 07 in your situation. Be sure and do your research on this to make an informed decision.

The BATF inspectors are neither lawyers or employees of DDTC/ITAR. The DDTC/ITAR July 22, 2016 Clarification made it pretty clear FFLs 01 or 07 who make, modify, improve, and/or use special tools need to Register with DDTC/ITAR. The punishment can be civil, criminal or both. The Management and Legal Branch of the BATFE will be crawling up the back sides of their Inspectors for giving their DDTC/ITAR opinions and not the facts. They have enough problems keeping their own regulations straight. I would highly suggest you read the DDTC/ITAR web site. To the best of my knowledge there have been no changes announced changing what was put out last July. I get the DDTC/ITAR, BATFE, TTB, NSSF, news letters and Government updates.
If you want to make chips, cut threads, modify, improve, use special tools as a 01 FFL and choose to not register with the DDTC/ITAR you are putting yourself at risk.
 
Received a reply from NRA/ILA on this subject just a few days ago. They hope the Trump administration will move jurisdiction of weapons export to the Commerce Dept. and this would solve the problem (same as they proposed under Obama, but he wouldn't do it). However, the NRA has no specific timeline for this happening.

But Nat is correct in what he says. On a side note, you may apply for a waiver to the DDTC/ITAR as there have been some granted to gunsmiths.

To the DDTC/ITAR.
When I contacted them I was told to read the rule requirement
. If you do anything thing to a gun . That is in the rules requirements you must pay the tax . Some so-called gun smiths have ignored the rules . We make and sell RAS tuners we are ITRA compliant . But we still can't export them . For those who don't abide by the rules
